A RESOLUTION ACCEPTING THE GIFT AND TRANSFER
OF NINE PARCELS OF PROPERTY TOTALING
APPROXIMATELY 8.1 ACRES TO THE CITY
WHEREAS, Article XX of the Colorado Constitution authorizes the City to acquire
by gift lands or interest in land, within or without the municipal limits; and
WHEREAS, the City Council intends that properties along the Goodnight Arroyo
will be set aside as a greenway corridor of public open space, parks; and
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
City Council hereby accepts the attached Special Warranty Deeds for the nine
parcels containing approximately 8.1 acres of properties as gifts and transfers of lands
to the City of Pueblo.
SECTION 2.
The City Clerk is directed to record the Special Warranty Deeds in the office of
the Clerk and Recorder of Pueblo County.
SECTION 3
Funds in the amount of $470.00 from the Planning Department's 2001
Professional Services Account No. 1011110- 411.30 -01, are hereby authorized to be
expended for the cost of a title insurance policy and uncollected property tax for the
properties.

BACKGROUND
In June, 2000, the Department of Planning and Development received authorization from City
Council to contact property owners along the Goodnight Arroyo that had expressed a desire to
donate property to the City. See the attached background paper dated June 5, 2000 and a copy
of the letter to Joe Holloran dated January 19, 2001. The discussions with these property owners
has resulted in three families offering to gift nine lots containing 8.1 acres along the Goodnight
Arroyo corridor to the City of Pueblo. The lots are located at the west of the Regency Park area
and are south of the City's old landfill (see attached map). The donation includes the Hudspeth
Family — 4.5 acres; Wilcoxson Family — 1.8 acres; and the Holloran Family — 1.8 acres. These
parcels may become part of a corridor that links from El Camino to the Arkansas River at the
Chain of Lakes area. The corridor may include portions of the Arkansas Valley Conduit (that
links into El Camino), along with sections of the Goodnight Arroyo. The corridor could include
a trail that passed through a series of open space areas and parks along a 3.5 -mile corridor. As
additional development is proposed and the roadway system including Bandera Boulevard is
extended through this area, additional properties are likely to be secured by the City.
FINANCIAL IMPACT
The City of Pueblo will pay $270.00 for a title insurance policy for the donated properties, and
approximately $200.00 for uncollected property taxes. In addition the City will be responsible
for the maintenance of the land following acceptance of the donation. The City already owns
15.6 acres of property adjacent to the donated property and the Regency Ridge Master Plan
identifies an adjoining 7 -acre parcel that will be deeded to the City as a detention/park facility in
the future.

ISSUE:
Should the City send letters to property owners along the Goodnight Arroyo that have
expressed a desire to donate park /open space property to the City, indicating the City's
willingness to accept the donation of these properties with a deed restriction that they are used
for open space and /or park uses?
BACKGROUND:
The Department of Planning and Development is proposing to have the City of Pueblo
provide a letter to the Hudspeth family and other property owners along the Goodnight Arroyo
who are interested in donating property to the City of Pueblo, provided the City is willing to
accept the donations with deed restrictions limiting the use of the property for future park land
or open space (see attached sample letter). The lots are located at the west of the Regency Park
area and are south of the City's old landfill (see attached map). The Hudspeth family has
indicated a willingness to donate five lots totaling seven acres. There is the possibility of having
2 -3 other parcels donated that are located along the arroyo. The properties would be accepted
by the City of Pueblo, subject to the City accepting a review of the environmental conditions of
the properties.
These parcels could become part of a corridor that links from the El Camino to the Arkansas
River at the Chain of Lakes area. The corridor could include portions of the Arkansas Valley
Conduit (that links into El Camino), along with sections of the Goodnight Arroyo. The
corridor could include a trail that passed through a series of open space areas and parks along a
3.5 -mile corridor.
As additional development is proposed and the roadway system including Bandera Boulevard is
extended through this area the additional open space /park and trail linkages could become
available to secure the property to preserve the open space corridor.
RECOMMENDATION:
Give direction on whether to send the letter indicating the City's willingness to accept the
donation of the lots along the Goodnight Arroyo that includes a deed restriction for open
space /park uses.

Dear Mr. Holloran:
Thank you for meeting with the City Planning and Development Department regarding
the possible donation of your property along the Goodnight Arroyo for park and open
space uses. This letter is to acknowledge the City of Pueblo's interest in accepting the
donation of the ten lots totaling approximately 8.55 acres that are located between the
Regency Ridge Subdivision, Filing 10 and the City's old landfill property. The City
owns the 15.6 -acre landfill property that is now closed and probably will remain as open
space. In addition the City will be accepting the dedication of a 7 -acre park/detention
pond site that is north of the old landfill site. The combination of these parcels, in
addition to your property donation, would increase the City's park and open space along
the west edge of the Regency Ridge area to 31.15 acres.
The City Council is willing to accept the property with a reasonable deed restriction that
limits the City's future use of the property to park, recreation and open space areas. This
restriction would provide a guarantee to you that the property will continue to remain as
either a park area or undeveloped open space into the future. The acceptance of the
property would be contingent upon a title examination, along with an environmental
review of the property that would determine if any adverse environmental conditions
exist. However, the City's acceptance of the property will not impose a financial
obligation on the City to develop the property for park and recreation purposes and
property may remain as undeveloped open space in its present condition.
The City is working on a park and open space plan for this area that identifies a series of
park and open space areas along portions of the Arkansas Valley Conduit and the
Goodnight Arroyo that are linked together by way of a trail system. The parks and trail
system is planned to ultimately connect from the El Camino Subdivision along a 3 -mile
corridor to the river trail along the Arkansas River west of the Nature Center.

For the Council's information, you will note that in the materials attached to this resolution is a
map locating the land being donated to the City. Adjacent to one of the parcels is lot #5 located
at the end of Osprey Court. This is the lot that I am in the process of purchasing for our home
and I thought it was important for you to know prior to accepting or rejecting the resolution. It is
equally important to know that this project started prior to my arrival; however I have been
involved in the matter since December 1, 2000.
