A RESOLUTION RESCINDING RESOLUTION NO. 9306 AND
AWARDING A CONSTRUCTION CONTRACT IN THE
AMOUNT OF $129,346.47 TO GOLDSTAR CONSTRUCTION
AND SETTING FORTH $4,453.53 FOR CONTINGENCIES
FOR HANDICAP CURB RAMPS (CDBG) AND
AUTHORIZING THE PURCHASING AGENT TO EXECUTE
THE SAME
WHEREAS, a construction contract for FY2001 Handicap Curb Ramps
(CDBG) was awarded to Maintenance Contractors of Colorado, Inc., on May 29,
2001; and
WHEREAS, Maintenance Contractors of Colorado, Inc., has failed to
provide the required performance bond and proof of insurance in accordance with
Article 3 — General Provisions of the contract; and
WHEREAS, new proposals for Handicap Curb Ramps (CDBG) have been received and
examined; and
WHEREAS, the proposal of Goldstar Construction, Inc., of Pueblo, Colorado, was the
lowest of those bids determined to be responsible;
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Resolution No. 9306 is hereby rescinded.
SECTION 2.
A contract for Handicap Curb Ramps (CDBG) be, and the same is hereby awarded to
Goldstar Construction Inc., in the amount of $129,346.47.
SECTION 3.
The Purchasing Agent be, and she is hereby authorized to execute said contract on behalf
of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and
attest the same.
SECTION 4.
Funds for this project shall be paid from the FY2001 Community Development Block
Grant Funds.
SF.CTTON 5.
In addition to the amount of the bid set forth, as aforementioned, an additional amount as
stipulated in this section is hereby established for contingencies and additional work.

ISSUE
Should the City Council award a construction contract for Handicap Curb Ramps
(CDBG) to Goldstar Construction for $129,346.47.
RECOMMENDATION
Approval of this Resolution.
BACKGROUND
The original FY2001 CDBG Fund allocation for the construction of handicap curb ramps
was $50,000. Subsequently, an additional $100,000 as added. Since Engineering had the
first project designed, it was put out to bid and an award was made to Maintenance
Contractors of Colorado, Inc., (MCCI) on May 29, 2001, by Resolution 9306. As a
condition of the contract documents, the contractor is required to provide a performance
bond and proof of insurance within 10 days of bid award. MCCI did not meet this
requirement and the purchasing agent for the City therefore cancelled the award. Another
project was subsequently put out to bid, including the handicap ramps from the first bid
plus the additional handicap ramps from the additional allocation, and Goldstar
Construction was the successful bidder. A summary of the bid results is attached. The
Committee of Awards, which consists of the City Manager, Director of Public Works,
and the head of the department or division or agency concerned, have considered the bids
and recommend the award be made to Goldstar Construction.
This project will include 75 ramps at 49 intersections. These locations were selected
based upon bus routes.
FINANCIAL IMPACT
Funds for this project will be paid from Community Development Block Grant funds.
Attached is a bid summary showing the results of competitive bids on this project.
