The Contract with Griffin Dewatering in the amount of $27,966.00, for dewatering services associated with the repair of the secondary clarifier at the Wastewater Treatment Plant is hereby approved, confirmed and ratified. SECTION 2 All action heretofore taken by the City Administration with respect to the Contract and Repair of the secondary clarifier at the Wastewater Treatment Plant be, and the same is, ratified, confirmed and approved. SECTION 3. Funds for said contract shall be paid from the Sewer User Enterprise Fund. ( "Griffin ") regarding dewatering for repairs to the existing Secondary Clarifier #1 at the wastewater treatment plant site in Pueblo. You have indicated that you now believe that the damage to the clarifier will be limited to the structure slab and not the sludge pit or center column area. Soil conditions in the area are believed to be as follows: Surface elevation - 4643.0+ 0'- 8' sand 8'-35' sand & gravel with cobbles The static water table at the time of the borings was approximately 8' below ground surface. We understand that the current static water level is somewhat higher and could be within 4' of the surface (elevation 4640.0 ±). Griffin agrees to provide dewatering well design, well installation and services adequate to effect a lowering of the static water level to a minimum of 18" below the elevation of the clarifier's main floor slab (original elevation before movement) in accordance with the following terms: Received at W WTP 07/30/01 9:34 AM Y GRIFFIN 1. Description of work Except as noted below, we will provide labor, materials, and equipment to drill and install five (5) wells around the perimeter of the City's #1 Secondary Clarifier to dewater an area of approximately 140'X 140'. The wells shall be drilled to a depth of 35' + , or to shale. Griffin will furnish and install a pump in each well (5 HP, 480V, 30) to accomplish the dewatering effort, and provide same for a pumping period of 30 calendar days after completion, testing and development of all of the wells and the issuance of state dewatering discharge permit. Four of the wells shall be constructed with PVC components and one well, designated by City as the permanent well, shall be constructed with 10 feet of stainless steel wellscreen (A304) and low carbon steel casing to surface. All wells shall be installed with 12" casing with gravel pack. The permanent well shall be grouted as required by the "Rules and Regulations for Water Well Construction, etc.," 2 CCR 402 -2 (June 1, 2000) for installation of permanent wells. Griffin cannot and does not guarantee that 5 wells of such rated capacity will be sufficient to accomplish the required dewatering. Consequently, if larger pumps are required, Griffin shall ship the larger pumps, freight prepaid, to the site. In that event, City will be responsible for setting the larger pumps and returning the original pumps to Griffin's yard in Omaha, Nebraska. All of this work shall be performed for a lump sum price of ....$27,966.00 2. Unit Prices Extra work will be provided at the following unit prices: Rental of pumps beyond 30 days: $550 /pump /month If a sixth well is required to obtain the desired lowering of static water level, Griffin shall drill and install the additional well for a sum of ............................$ 4,824.00 City shall have the option to purchase one or more of the pumps at any time for $2,705.00 each, with the price to include the pump, motor, electric cable and size #1 NEN A 3R control panel. City will be credited with 90% of the first 30 day rental fee ($ 495.00 per pump) toward this price. Rental paid on the 5HP pumps will not apply toward purchase of larger pumps. Y GRIFFIN 3. Time Time is of the essence for the Owner in order to effect emergency repairs. Consequently, Griffin shall mobilize at the project site and shall commence drilling not later than July 27th, 2001 and, thereafter diligently prosecute the project work to completion within 14 calendar days. 4. Owner's Responsibility The owner (or others) will be responsible for: (a) supply of a front end loader and operator to transport gravel to the well locations, and assist in moving Griffin's equipment around the site, (b) suitable water supply for Griffin's drilling operations, (c) all electrical power, wiring, and connections to Griffin's pumping equipment, and (d) the laying of all discharge piping. Griffin shall provide Owner with not less than seventy -two (72) hours advance written notice of its specific requirements for electrical, water supply, piping and other items. Except with respect to the permanent well, upon completion of the dewatering, all pumping equipment (including screen and casing) shall be pulled and disassembled by Owner and returned to Griffin in Omaha, Nebraska. 5. Payment City shall make a partial payment of 75% of the contract price upon completion of well installation, and pay the remainder of the contract price upon completion of initial successful dewatering to the specified elevation. The foregoing payments will be made within thirty days of receipt of invoice. 6. Entire Contract This proposal incorporates the Standard Terms and conditions attached hereto. The Standard Terms and Conditions shall be incorporated into any contract documents and where there might be any inconsistency, these Terms and Conditions shall control. 7. Permits This proposal excludes all permits and licenses required ew pt fe ,.,,.,*...,, to f and we drille It will be up to the Owner to obtain the required NPDES permit for the discharging of groundwater AND to provide all monitoring and sampling of said discharge water per the requirements of the permit. This proposal excludes responsibility for abandonment of wells. r GRIFFIN 8. Exclusions UNDER NO CONDITIONS SHALL GRIFFIN ACCEPT ANY RESPONSIBILITY (LIABILITY) FOR LIQUIDATED DAMAGES, HAZARDOUS/TOXIC SUBSTANCES OR SUBSIDENCE 9. GRIFFIN DEWATERING, NORTH CENTRAL, L.L.0 STANDARD TERMS AND CONDITIONS This agreement and any offer by any Griffin company (Griffin) is subject to the following terms and conditions. The provisions contained herein shall govern and supercede any other terms and conditions, including but not limited to general conditions, supplementary or special conditions or clauses, or other provisions of bid documents or prime contract if any, and no other writing or statements will waive or modify these terms or conditions unless expressly waived or modified in writing by Griffin. No changes, modifications, or amendments to any of these terms and conditions shall be valid unless expressly agreed to in writing by Griffin. Prior to the commencement of work by Griffin and throughout the performance of Griffin's work, the purchaser shall solely be responsible for the following items and their associated costs and they are excepted from any work to be provided by Griffin: 1 Construction and maintenance of berms, dikes, ditches, equipment pads, excavations, backfill, all excavation shoring, ramps, sumps, trenches, well sites, and all other reasonable and necessary site preparation, and protection of the work site from caving or collapsing. 2 Construction and maintenance of access roads capable of accommodating two -wheel drive construction and support vehicles under their own power to all work sites, and providing a clear area for Griffin's work. 3 Construction, assembly, and maintenance of all necessary catwalks, ladders, and scaffolding, bracing, cribbing, and other equipment support necessary for preforming the work. 4 Performance of a site survey which physically indicates by survey stakes the location of all well sites and other equipment and materials to be installed in accordance with this agreement. 5 Removal of unusual or unnatural underground and surface obstructions including concrete. 6 Marking and any necessary relocation or protection of all on -site and surrounding utilities and service lines, above and beneath the ground. 7 Preparation of suitable secure areas for equipment and material storage, field buildings, office trailers, and tool sheds, and adequate work and security lighting. 8 Provide and maintain as current all permits and licenses required for the completion of Griffin's work except Griffin's state and local contracting and drilling licenses. 9 Provide adequate protection of Griffin equipment from freezing and flooding conditions. 10 Provide jobsite security, and all required pedestrian and traffic control, and protection. 11 Provide access to adequate sanitation facilities, adequate communications facilities, and access to adequate emergency services which will satisfy all Federal and State law requirements. 12 Provide adequate control of water resulting from or accumulating as perched or trapped water, overtopping water, runoff, seepage, surface water, interface water, and water in any other form not contemplated by Griffin's dewatering plan as set forth in its proposal. 13 Provide adequate treatment and control of erosion and sedimentation caused by discharge water or other runoff. 14 Provide all required: monitoring, sampling, testing, containment, treatment, and disposal of discharge water including, if necessary, containment, cleanup (settling and /or turbidity curtains, etc.), and set the discharge so as to not recharge the dewatered areas. 15 Provide containment, treatment, and disposal of all drilling cuttings, excavation spoil, and spent drilling and jetting fluids and all other fluids which are the by product of the work. 16 Provide access to areas and facilities for the cleaning and decontamination of Griffin equipment, personnel. 17 Payment of all expenses resulting from loss or damage to Griffin's equipment caused by Purchaser including the costs of replacement removal, return, and repair. 18 Provide all necessary pads and/or benches to facilitate the installation to the dewatering equipment including 5 feet of reverse head for the drilling of wells. 19 Provide adequate and readily accessible water source at the work locations including water meter if required. 20 Provide suitable electrical power and stand -by power adequate for the equipment described in the proposal. 21 Provide all personnel for operation and maintenance ( including start -up and testing ) of all dewatering equipment installed including manpower, fuel, electricity, lubricants, fuel tanks , standby power, and all system monitoring. 22 Provide a suitable crane and front -end loader which are manned, fueled, and maintained for Griffin's use during all installations and removals. These would be no longer than three days for the front end loader and two days for the crane. 23 Provide removal and return of Griffins equipment upon completion of the rental. 24 Provide for restoration of the work site upon project completion, including the abandonment of wells, wellpoints, piezometers, monitoring wells, or other holes, and any remedial or restoration repairs to concrete asphalt or other surfaces and grouting. 25 Provide all required sound barriers, walls, or other visual and sound isolation. The following are the General Supplemental Provisions of this contract A. The scope of work and/or equipment to be provided by Griffin shall be solely as defined in this agreement or offer. The scope of work shall not include, or be defined by any other documents, clauses or specifications unless specifically set forth in this agreement or offer. B. Griffin intends to perform its work in a continual and uninterrupted manner, on a 40 hours per week/8 hours per day basis. The purchaser shall be responsible for all reasonable costs and additional charges associated with any delays in Griffins work to the extent the purchaser has caused the delay. The Purchaser shall grant reasonable additional time to complete the work delayed by no fault of Griffin. The purchaser shall be responsible for all reasonable costs and additional charges associated with any delays in Griffin's work to the extent the Purchaser has caused the delays. C. All scheduling of work under this contract shall be by mutual agreement prior to the commencement of the work. All work stoppage or interruption which is not due to action or inaction of Griffin, but occurring during time that Griffin is mobilized for the project, shall be charged at the hourly rental rates of the equipment and service rates of the personnel on the jobsite. D. Griffin shall not accept or be bound by any liquidated damage or consequential damage provisions of any contract which this contract, or the work described herein is the subject of, unless expressly agreed to by Griffin, in writing. E. Griffin shall provide at its own expense and maintain during the term of the contract standard liability and workers compensation insurance coverage. A certificate of Insurance will be furnished upon request. This certificate of Insurance even if it lists other parties as named insured shall not expand Griffin's duty to indemnify or insure beyond those duties specifically stated herein. Griffin shall be reimbursed for the costs of any additional coverage requested in excess of its existing policy. Any other risk of loss or liability is the responsibility of Purchaser including but not limited to loss or damage to work unless that loss is a direct result of a Griffin act. Griffin Dewatering Corporation shall not be liable for or required to provide any Bond, or costs thereof unless it specifically agrees to provide a bond writing prior to commencement of its work. F. Purchaser agrees to indemnify and hold Griffin harmless from and against any and all causes of action, claims, and suits and to indemnify and reimburse Griffin for court costs and reasonable attorney's and witness fees associated with the defense of any and all such matters that are the result of Purchasers action or inaction to the extent that the Purchaser , its agents assigns or contractors are negligent or at fault, and all causes of action claims and suits concerning alleged damages to property resulting from Griffin's participation in this project, including but not limited to alleged subsidence and/or settling and alleged damages to private and/or public wells, and to indemnify and reimburse Griffin for court costs and reasonable attorney's and witness fees associated with the defense of any such matter. Further, purchaser agrees to indemnify and hold Griffin harmless from and against any and all causes of action, claims, and suits concerning the presence of any contaminated, hazardous, or toxic matter located on or near the project site and to indemnify and reimburse Griffin for court costs and reasonable attorney's and witness fees associated with the defense of any such matter. Purchaser further agrees to assume all costs associated with the handling and disposal of any contaminated, hazardous, or toxic matter encountered during the course of this project. G. All notices to Griffin are not effective until they are received at the Griffin office that originated this contract. 1. This contract and the pricing contained herein is based on site conditions and borings provided by the purchaser. Griffin has made no independent verification of those conditions. It is acknowledged by Purchaser that, if conditions are materially different than those presented to Griffin prior to this contract Griffin may submit a request for modifications of this contract. J. No warranty is either express or implied except as stated in this contract. Pumps purchased by the city will be covered the manufacturers warranty. K. Terms are net 30 days. Purchaser agrees to pay Interest for past due amounts, which shall be charged at 8% per annum. L. All estimates of contractor supplied material are estimates and Griffin is not responsible if quantities needed exceed those estimates. Background Paper for Proposed AGENDA ITEM #!f DATE: August 13, 2001 DEPARTMENT: WASTEWATER DEPARTMENT TOM CVAR, Director of Public Works TITLE A RESOLUTION APPROVING AND RATIFYING A CONTRACT WITH GRIFFIN DEWATERING FOR $27,966.00 FOR EMERGENCY DEWATERING SERVICES ASSOCIATED WITH THE REPAIR OF THE SECONDARY CLARIFIER AT THE WASTEWATER TREATMENT PLANT ISSUE Should City Council approve a Resolution approving and ratifying a contract with Griffin Dewatering for emergency dewatering services associated with the repair of the secondary clarifier at the wastewater treatment plant. RECOMMENDATION Approval of the Resolution BACKGROUND On June 8, 2001, one of three secondary clarifier tanks at the Wastewater Treatment Plant was damaged by external hydrostatic pressure while being emptied for maintenance purposes. The tank was immediately refilled with water to equalize internal and external hydrostatic pressures, however, the tank must be completely drained to evaluate the damage and to make the necessary repairs. To do this without incurring additional damage, the groundwater around the tank must be pumped down to eliminate the external hydrostatic pressure. This Resolution approves and ratifies a contract with a company that specializes in dewatering construction sites. FINANCIAL IMPACT Funds for this project will come from contingency funds in the Sewer User Enterprise Fund.
