HomeMy WebLinkAbout09348RESOLUTION NO. 9348 A RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN PUEBLO, A MUNICIPAL CORPORATION AND PUEBLO COUNTY, COLORADO CONCERNING FY 2001 LOCAL LAW ENFORCEMENT BLOCK GRANT FUNDING AND AUTHORIZING THE PRESIDENT OF THE CITY COUNCIL TO EXECUTE SAME BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 The Memorandum of Understanding between Pueblo, a municipal corporation and Pueblo County, Colorado, concerning receipt and disbursement of Local Law Enforcement Block Grant Funds anticipated for receipt in federal fiscal year 2001 from the United States Department of Justice (the "MOU"), a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2 City matching funds required under the terms of the Grant and MOU, in an amount not exceeding $26,986.00, are hereby authorized to be transferred from general fund prior year unencumbered fund balance. SECTION 3 The President of the City Council is authorized to execute and deliver the Contract in the name of the City and the City Clerk is directed to affix the seal of the City thereto and attest same. For FY2001, the Local Law Enforcement Block Grant for Pueblo City and Pueblo County has been certified as disparate. That is, the Office of Justice Programs, which administers the grant, requires the City and the County divide $317,875.00 in funds to their mutual satisfaction. If the parties are unable to reach a mutual agreement, no jurisdiction is eligible to receive funds. RECOMMENDATION The Police Department recommends approval of this resolution BACKGROUND The Local Law Enforcement Block Grant Program provides funds to units of local government to reduce crime and improve public safety. The program is designed to help local communities address problems specific to their area. The City of Pueblo has participated in the LLEBG program since its inception in 1996. FINANCIAL IMPACT LLEBG requires local jurisdictions provide matching funds. The City of Pueblo has been awarded $242,875.00 for 2001. The amount of matching funds is $26,986.00. MEMORANDUM OF UNDERSTANDING CONCERNING RECEIPT AND DISBURSEMENT OF LOCAL LAW ENFORCEMENT BLOCK GRANT FUNDS FOR FY 2001 THIS MEMORANDUM OF UNDERSTANDING is made and entered into this 3rd day of July, 2001, by and between the City of Pueblo, a Municipal Corporation (hereinafter referred to as the "City ") and Pueblo County, Colorado (hereinafter referred to as the "County"). WITNESSETH: WHEREAS, the parties recognize that for FY 2001 Local Law Enforcement Block Grand ( LLEBG) funding, administered by the U.S. Office of Justice Programs, Pueblo County has been certified as a disparate jurisdiction by the Colorado State Attorney General's Office; and WHEREAS, Federal Local Law Enforcement Block Grant funding requires that a certified disparate county and the city or cities within the county are to divide available funds to their mutual satisfaction, and that if the parties are unable to reach a mutual agreement, no jurisdiction is eligible to receive funds; and WHEREAS, the parties met on June 6, 2001 and reached an agreement over the receipt of $317,875.00 in LLEGB funds and the disbursement of those funds and wish to set those forth in the following manner. NOW, THEREFORE, in consideration of a mutual agreement and in accordance with Federal law, the parties agree as follows: The City will receive $242,875.00 and had budgeted that amount to use on yet to be determined equipment. The City will match these funds with $26,986.00 as part of the project. The County will receive $75,000.00, of which the Pueblo County Sheriffs Department will receive $60,000.00 to purchase equipment and /or personnel for law enforcement. These funds will be matched by $6,667.00. The Pueblo County District Attorney will receive the remaining $15,000.00 of the County's allocation. These funds will be matched by $1,667.00 in cash or equivalent purchases which are part of the project to assist law enforcement.
