HomeMy WebLinkAbout09219RESOLUTION NO. 9219 A RESOLUTION APPROVING A LETTER OF UNDERSTANDING BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND PUEBLO COUNTY AND ITS DEPARTMENT OF PLANNING AND DEVELOPMENT RELATING TO PARK PLANNING AND DESIGN SERVICES FOR AGREED UPON PARK PROJECTS THAT ARE OF MUTUAL INTEREST TO BOTH PARTIES AND AUTHORIZING THE PRESIDENT OF COUNCIL TO EXECUTE SAME WHEREAS, the City of Pueblo through its Department of Planning and Development and the County of Pueblo through its Department of Planning and Development desire to enter into a letter of understanding to, in the spirit of cooperation, provide Park Planning and Design Services; and NOW, THEREFORE, BE IT RESOLVED by the City Council that: SRCTTON 1 _ The Letter of Understanding between the City of Pueblo and its Department of Planning and Development and the County of Pueblo and its Department of Planning and Development, a copy of which is attached hereto and incorporated herein, having been approved as to form by the City Attorney is hereby approved. The President of City Council is hereby authorized to execute and deliver said Letter of Understanding in the name of and on behalf of the City of Pueblo, a Municipal Corporation, to the Pueblo County Department of Planning and Development. RECOMMENDATION Approval of the Resolution BACKGROUND The City and County Planning Departments have developed a work program whereby the City Planning Department will complete agreed upon park planning and design projects during FY2001 for Pueblo County totaling approximately 850 hours. The projects include park master planning, park designs, enhancement project planning, trail project designs and the completion of funding applications for projects that are of mutual benefit to the City and County. The County will compensate the City up to a fixed fee of $25,000 on an estimated percent - completed basis. The work program includes specific projects totaling approximately 734 hours, and approximately 116 hours for new projects and additional work (see attached Letter of Understanding). The City will bill the County on a quarterly basis for the work that is completed according to the hourly fee schedule included as part of the agreement. Pueblo City Council February 12, 2001 Page Two Please Note: The City Attorney's office has reviewed and approved the attached Letter of Understanding as to form. This agreement has only recently forwarded this agreement to the County Attorney's office for review. At the time of this writing the County Attorney has not yet had sufficient time to review the agreement and approve as to form, and the Board of County Commissioners have not acted to approve the agreement. Should there be changes in the agreement, a substitute copy will be submitted to City Council on February 12, 2001. FINANCIAL IMPACT The Planning and Development Department will need, as time allows, to commit staff time during FY2001 to complete the projects. The City's project - related direct expenses will be paid by Pueblo County based on the Weighted Hourly Rate for Planning Department employees, along with additional expenses incurred by the City to complete the specific tasks. City of Pueblo Planning & Development Department Park Planning & Design Letter of Understanding SCOPE OF SERVICES: The City of Pueblo through its Planning & Development Department will complete work totaling approximately 850 hours during the FY2001that would include park master planning, park designs, enhancement project planning, trail project designs and the completion of funding applications. The City of Pueblo through its Planning & Development Department will perform park planning and design services on an estimated percent complete basis of a fixed fee of $25,000 for the completion of the tasks agreed to for the 850 hours of service in accordance with the Professional Fee (Appendix A). The fixed fee includes all the City's project - related direct expenses to complete the agreed upon tasks described within this Letter of Understanding in Section 1 hereof. The City will bill the County on a quarterly basis and the County shall pay such billings within ninety (90) days after receipt. The City and the County have agreed to several projects, the tasks associated with each project, and projected number of hours for each project identified in Section 1 (the "Work Program"). The Work Program is proposed to include specific projects totaling approximately 734 hours, and approximately 116 hours of park, trails, open space, and grant writing work that have been identified and agreed upon by Pueblo County and the City of Pueblo. The County will only be billed for the hours that the City Planning Department spends time working on the Work Program according to the hourly fee schedule included as Appendix A attached hereto and incorporated herein by this reference. The lead contacts from each entity which all contacts and communication related to this Letter of Understanding for work to be completed in conjunction with this project shall be addressed are listed below: Pueblo County Kim Headley, Director of Planning and Development City of Pueblo Jim Munch, Director of Planning and Development SECTION 1. AGREED UPON WORK PROGRAM AND PROJECT MASTER PLANS FOR TWO EXISTING COUNTY PARKS: Goal: Update and expand the existing master plan for Runyon Field and complete a park master plan for Rye Mountain Park. Runyon Field Tasks: (1) Complete park master plan site plan drawings and a final master plan document for Runyon Field that includes the addition of one new baseball field, new parking areas to make up for any loss of parking due to the new ballfield, and other improvements to the existing Runyon Field Sports Complex. The final master plan will include the following: a. Site plan drawings and site improvement illustrations that will be completed in 2001. b. A final master plan document that contains the site plan drawings and site improvement illustrations (to be completed in 2001), as well as a plan narrative, cost estimates, and project phasing that was completed in 2000. Products: (1) One (1) reproducible master plan document that includes the following: a. A proposed improvement site plan. b. A master plan narrative reviewing existing conditions, plan development process, proposed improvements, estimated improvement costs, and phasing of improvements. (2) An electronic copy of the master plan narrative. Materials & Services To Be Provided By Pueblo County: (1) No additional materials need to be provided by Pueblo County to complete this project. Duration: 100 hours — which includes 80 hours for plan drawings and 20 hours to format and layout master plan document. Rye Mountain Park Tasks: (1) Complete a master plan including a site plan showing future upgrades to existing facilities and proposed new improvements; a written narrative reviewing the improvements shown on the site plan, along with recommendations addressing the protection of the park's resources. (2) Complete a cost estimate and the phasing schedule for proposed facility upgrades and proposed new improvements. Products: (1) One (1) reproducible master plan document that includes the following: a. A proposed improvement site plan. b. A master plan narrative reviewing existing conditions, plan development process, proposed improvements, estimated improvement costs, and phasing of improvements. (2) An electronic copy of the master plan narrative. Materials & Services To Be Provided By Pueblo County: (1) A base map showing the location of all existing facilities, utility lines, improvements and other infrastructure (mylar and CAD format). (2) Rye Mountain Park operation budget, facility use numbers, and a list of facility "needs ", both immediate and long range. 2 Note: Park inventory information that includes park size, facilities, equipment, park infrastructure improvements, as well as an assessment of the condition of these facilities and improvements. A park inventory has been included as a component of the Pueblo County Parks Master Plan Project that has been submitted to GOCO for funding assistance. If the parks master plan is not funded by LOCO, Pueblo County has committed resources to complete an inventory of Rye Mountain Park during 2000. Duration: 244 hours FRONTIER PATHWAYS SCENIC BYWAY CORRIDOR BYWAY COORDINATION ACTIVITIES AND INTERPRETATION PLANS: Goal: Identify and develop funding for the Byway portion of projects that are consistent with the Frontier Pathways Scenic Byway Corridor Management Plan that includes interpretive plans for the El Pueblo Museum and the Arthur Carhart/U. S. Forest Service early recreational planning efforts in the Pueblo region. These projects are being completed in cooperation with funding from the City of Pueblo and the Frontier Pathways Scenic Byway, Inc. Tasks: (I) Byway Information and Project Development: a. Arrange and conduct a series of meetings in Pueblo and Pueblo County to introduce the nationally designated Frontier Pathways Scenic & Historic Byway to a wide range of community organizations and governmental entities. b. Identify new or existing projects consistent with the Byway Corridor Management Plan. c. Depending upon the individual project the some or all of the following coordination activities will be provided: • Provide assistance in the form of a direct grant request by the Byway for funding utilizing Byway funding sources. • Arranging for cash or in -kind match for grant proposals. • Preparing letters of support from the Byway for grant proposals. • Provide day -to -day liaison with the Byway management team. (2) Monitor the development of the Byway portion of the El Pueblo Museum expansion project: a. Working with the State Historical Society, the facility's designers, and the City and the County, develop an interpretive plan for both indoor and the outdoor elements of the Byway portion of the Museum. b. The interpretive plan will identify theme(s) to be interpreted at the site as well as general recommendations about the physical layout of the Byway node. c. Ensure that the recommendations in the interpretive plan can be accommodated by the Byway's portion of the expansion project's budget. (3) Arthur Carhart and U.S. Forest Service Recreational Planning: a. Develop an inventory of documents, objects, and historic sites related to Arthur Carhart that document the involvement of Pueblo and Pueblo County and their citizens in the nations' early U.S. Forest Service /community recreational planning efforts on national recreational policy and implementation. 3 b. Identify and place into context the significant impacts of Carhart and the City's and County's efforts on national recreational policy and implementation. c. Develop and write an Interpretive Management Plan that proposes one or more venues that will interpret Carhart and Pueblo and Pueblo County role in national recreational planning and implementation. d. The Interpretive Management Plan will include a thorough analysis of the efficacy, type, and scope of interpretive venues that could benefit the community economically, as well as funding sources to implement the plan. Products: (1) Byway projects - prepare a report identifying new or existing projects that are consistent with the Corridor Management Plan and funding assistance depending upon the project. (2) Complete a reproducible interpretive plan document for both indoor and outdoor elements of the Byway portion of the El Pueblo Museum. (3) Carhart/Recreational Planning Project: a. Complete a report that contains an inventory that places into context the significance of Carhart and the City's and County's efforts on national recreational policy and implementation. b. Complete a reproducible interpretive plan document based on information gathered that proposes one or more venues that interpret Carhart and the Pueblo and Pueblo County roles in national recreational planning and implementation. (4) Electronic copies of reports and interpretive plans. Materials & Services To Be Provided By Pueblo County: (1) Provide information that has been developed by Pueblo County for existing or future Byway projects. (2) Provide information from Pueblo County that could be included in the inventory and analysis of Arthur Carhart and recreational planning efforts in the Pueblo region. Duration: 300 hours ST. CHARLES RIVER ESTATES CONSERVATION EASEMENT: Tasks: (1) Complete an easement document for the St. Charles River Estates Subdivision that will be used as the first draft of a conservation easement that would be placed on approximately 1,800 acres of property owned by Red Creek Ranches. (2) Review the easement document with the Red Creek Ranches, the Pueblo County land use attorney, and the attorney representing Keep Pueblo Beautiful Association, Inc. Make appropriate revisions to the conservation easement that is agreed upon by all three entities. Products: (1) A conservation easement document on approximately 1,800 acres of property that placed on the property within the St. Charles River Estates PUD. Duration: 40 hours 4 PROJECT FUNDING APPLICATIONS: Tasks: (1) Complete one (1) grant application for park improvements, land acquisition for trails and parks, and trail facility construction. The grant application will be prepared for one of a variety of funding sources that includes Great Outdoors Colorado (LOCO) Local Government funds, GOCO trails funds, and TE21 Transportation Enhancement funds. Products: (1) One (1) original grant applications that follows the guidelines for the funding source and Pueblo County. Materials & Services To Be Provided By Pueblo County: (1) An estimated 40 hours of assistance from Pueblo County per application to secure funding partners, county commissioner approvals and resolutions, and letters of support from other partners for each grant application. Duration: 50 hours, with 40 hours per application from Pueblo County to assist with securing funding partners, county approvals and resolutions, and letters of support. SECTION 2. OTHER WORK PROGRAM AND PROJECTS In addition to projects listed in Section 1 there is approximately 116 hours of time that could be committed to new projects or additional work on the projects listed in Section 1 upon agreement of City and County. Other projects that could be worked on, but are not part of the agreed upon Work Program and Projects include the following: Arkansas River Trail Expansion Tasks: (1) Contact the current property owners where the proposed trail is planned to be located to determine if it is feasible to secure property to continue on with this project. (2) Update trail alignment plans as needed to extend the River Trail System along SH 227 and east to Aspen Road, along with extending a trail east along the Arkansas River to the CF &I ponds and onto the bluff linking with the existing road system. Products: (1) Written letter and documents needed to support the acquisition of the property for the trail project. Duration: 50 hours McHarg Park Master Plan Tasks: (1) Complete an updated and expanded master plan for McHarg Park identifying upgrades to existing areas and facilities and proposed new improvements; include an updated site plan; and a written narrative reviewing the improvements shown on the site plan. The plan will also address proposed infrastructure improvements to the park such as changing the source of water for irrigating the turf grass and trees. (2) Complete a cost estimate and the phasing for proposed facility upgrades and proposed new improvements. Duration: 198 hours Liberty Point Park Master Plan Tasks: (1) Complete an updated and expanded master plan for Liberty Point Park identifying upgrades to existing areas and facilities and proposed new improvements; include an updated site plan; and a written narrative reviewing the improvements shown on the site plan. (2) Complete a cost estimate and the phasing for proposed facility upgrades and proposed new improvements. Duration: 196 hours Pleasant View Middle School/Park Facility Master Plan Tasks: (1) Complete a master plan for an expanded school/park site at Pleasant View Middle School with input from Pueblo School District 70. Pueblo County shall identify a public participation process to be conducted by the City of Pueblo Planning & Development Department, with assistance from the Pueblo County Public Works Department and other groups identified by Pueblo County. Products: (1) Master plan that includes a site plan identifying upgrades to the existing facility and proposed new improvements. (2) Complete a phasing plan for the proposed facility upgrades and proposed new improvements. (3) Complete cost estimates for the facility upgrades and proposed improvements. Duration: 272 hours Additional Projects Agreed Upon By Pueblo County and the City of Pueblo Tasks: (1) Pueblo County and the City of Pueblo will have the option of adding additional park, trails, open space and grant writing projects to the Scope of Services that are mutually agreed upon and comply with the overall parameters of this Letter of Understanding. Nil Products: (1) The products will be agreed upon by Pueblo County and the City of Pueblo based on the tasks and the scope of each project. The fixed fee of $25,000 includes all professional fees and associated direct expenses. The following hourly rates reflect the varied expertise levels that we feel will be required for the completion of the projects and tasks. When the following proceedings, among others, were had and done, to wit: RESOLUTION NO. 01 -48 APPROVING A LETTER OF UNDERSTANDING BETWEEN THE CITY OF PUEBLO AND PUEBLO COUNTY BETWEEN THEIR RESPECTIVE DEPARTMENTS OF PLANNING AND DEVELOPMENT RELATING TO PARK PLANNING AND DEVELOPMENT WHEREAS, the City of Pueblo through its Department of Planning and Development and Pueblo County through its Department of Planning and Development desire to enter into a Letter of Understanding to, in the spirit of cooperation, provide park planning and design services; and WHEREAS, the Pueblo County Department of Planning and Development recommend that the County enter into said Letter of Understanding with the City of Pueblo to cooperate with each other on several projects relating to park planning and development; and WHEREAS, the City of Pueblo through its Plaiming and Development Department will perform certain park and planning design services for Pueblo County based on an hourly fee to be billed to the County on a quarterly basis in an amount not to exceed $25,000.00 and which includes 850 hours of work during the year 2001; and WI IEREAS, the Board of County Commissioners of Pueblo County find this to be in the best interest of Pueblo County citizens and concur with the recommendation of the Pueblo County Planning and Development Department and desire to enter into said Letter of Understanding with the City of Pueblo, subject to appropriation of funds for this purpose.
