A RESOLUTION APPROVING AMENDMENT NO. 7 TO THE
AGREEMENT BETWEEN THE CITY OF PUEBLO AND DESIGN
STUDIOS WEST, INC., FOR PROFESSIONAL SERVICES
ASSOCIATED WITH THE HISTORIC ARKANSAS RIVERWALK
PROJECT.
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1
The Amendment No. 7 to the Agreement for Professional Engineering Services associated
with the Historic Arkansas Riverwalk Project, by and between the City of Pueblo, a Municipal
Corporation, and Design Studios West, Inc., a copy of which is attached hereto, having been
approved as to form by the City Attorney, is hereby approved.
SECTION 2
The President of the City Council is hereby authorized and directed to execute said
Amendment in substantially the same form as attached, for and on behalf of the City of Pueblo, and
the City Clerk is hereby directed to attest same and affix the seal of the City thereto.
SECTION 3
Funds for said Professional Services, in the amount of $60,000, shall be paid from proceeds
provided by the HARP Foundation.

ISSUE
Should the City Council approve Amendement No. 7 to the Agreement between the City
of Pueblo and Design Studios West, Inc., for Professional Services associated with the
Historic Arkansas Riverwalk Project.
RECOMMENDATION
Approval of this Resolution.
BACKGROUND
This Amendment No. 7 to the contract with Design Studios West will provide detail
design and construction documents for the Boettcher Outdoor Education Center at the
east end of the Historic Arkansas Riverwalk. The project will consist of the Pikes Peak
Plaza, restroom facilities, a canopy over the existing seating area, lighting, landscaping
and educational signage. The project is estimated to cost at total of $600,000.
FINANCIAL IMPACT
Design fees are estimated not to exceed $60,000 and will be paid by the HARP
Foundation under the terms of an agreement approved by the City Council. The Planning
Department and the Public Works Department will provide in house administrative
services to oversee the design and construction of the project.
AMENDMENT NO.7
AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES
THIS AMENDMENT NO. 7 to Agreement for Professional Engineering Services
is made and entered into this 22nd day of January, 2001 by and between the City of
Pueblo, a Municipal Corporation (herein after referred to as "Owner ") and Design
Studios West, Inc., (herein after referred to as "Engineer ").
WHEREAS, Owner and Engineer have heretofore entered into an agreement
dated November 27, 1995 and Amendments to that agreement dated July 22, 1996;
September 23, 1996; April 14, 1997; June 8, 1998; October 26, 1998, and December
14,1998, (hereinafter referred to as "the Agreement "), wherein Engineer agreed to render
certain professional engineering and related services for Owner in connection with the
Historic Arkansas Riverwalk Project (hereinafter referred to as the "Project "); and
WHEREAS, the parties agree that an Amendment to the Agreement is necessary
and desirable to increase the contract amount for the following additional services:
a) Boettcher Outdoor Education Center
Restrooms and Storage
Structural Shade Cover at Existing Amphitheater
Interpretive and Historic Signage
b) Anderson Gardens
Wildflower Garden
Interpretive and Education Signage
Sitting Areas
C) Pikes Plaza
- Pikes Monument (relocated)
- Educational and Historical Signage
- Interpretive Paving
- Mural or Sculpture of Zebulon Pike
- Bus Drop -off
d) Houston Commons (entire area)
Native Plantings
- Wildflowers
- Wetlands
- Trails
- Signage
NOW THEREFORE, in consideration of the foregoing and mutual terms and
conditions set forth herein, the parties agree as follows:
1. The Agreement is amended by expanding the scope of work to include the
additional services outlined in Appendix "A" to this Amendment.
2. The Engineer shall complete the work items generally described in Appendix
"A" to this Amendment in accordance with the terms of the Agreement.
3. With respect to Engineer's services provided under this Amendment,
Appendix "B ", "Fee Schedule" of the Agreement shall apply to compensation
payable for key personnel, reimbursable expenses, and media costs, and shall
be increased in the amount of $60,000 for the work authorized by this
Agreement.
4. Except as expressly modified by this Amendment, the Agreement shall remain
in full force and effect. Any obligations remaining to be performed under the
original Agreement by either party, relating to the professional services to be
performed by Engineer generally or with respect to other phases of the Project
are not waived or excused in any manner, but shall be fully performed in
accordance with the terms and conditions of the Agreement as it existed prior
to this Amendment.
IN WITNESS WHEREOF, Owner and Engineer have executed this Amendment
No. 7 to Agreement for Professional Engineering Services as of the date first above
written.

APPENDIX A
SCOPE OF SERVICES
The scope outlined below is based on our meeting and a preliminary tour of the site on
July I I along with a subsequent meeting on November 7` It is also based our knowledge
of the HARP project and the sketch plans that we have prepared previously. The scope may
be adjusted and modified as appropriate to respond to concerns and reviews by staff or
any review committee that may be established.
Design Studios West, Inc. will coordinate a team of sub - consultants as necessary including
an architect to develop the restroom and shade structure for the Boettcher Outdoor
Education Center along with any supporting improvements such as, mechanical, electrical,
structural, geotechnical and other utility considerations. In addition to the team
coordination effort, DSW will be responsible for the following work items.
LOSchematic Design
• Gather all information on existing conditions of site.
• Review existing site conditions based on previous experience with the HARP
Project.
• Review previous "sketch" plans and incorporate new programs elements as defined
by meetings with City Planning group and donors.
• Develop a Schematic Site Plan that identifies location, materials, and character of
proposed site improvements such as: walks, shade structure, restrooms, plantings,
plazas, sitting areas, public /historic /interpretive art, etc.
• Coordinate design and location of structures with architects as needed.(restrooms,
shade structure)
• Assist Foundation in Artist selection and procurement. (statuary or mural)
• Prepare a preliminary estimate of probable construction costs for all improvements
identified in the Schematic Plan.
+ Review with City staff, assigned committee members and interested donors, the
Schematic Plan and cost estimate and identify highest priority improvements.
Identify all conflicts, suggested revisions, additions or deletions, and construction
material choices related to costs.
• Develop sketch(s) to accompany specific Grant applications by the
Foundation. (Pike's Plaza).
2.0 Design Development
• Coordinate Design Team
• Hold DD start -up meeting with Design Team.

• Develop final detailed design plans based on approved direction from Schematic
Design phase.
• Develop preliminary details, sketches and sections of all site elements with
materials and finishes defined.
• Prepare an estimate of probable construction costs for all improvements identified
in the Final Plan.
• Review with City staff and assigned committee members, the Final Design Plan with
cost estimate and identify all conflicts, suggested revisions, additions or deletions,
and construction material choices related to costs. (value engineering)
• Prepare outline specifications for materials and construction methods
• Prepare a Design Development package for review and costing (by third party).
• Review with City staff and assigned committee members the Design Development
package with cost estimate and identify all conflicts, suggested revisions, additions
or deletions, and construction material choices related to costs
3.0 Construction Documentation
• Coordinate Design Team
• Hold CD startup meeting with Design Team.
• Prepare Construction Documents for all approved site improvements, with bid
alternates assigned based upon priorities established by the Foundation.
• Develop final construction details and specifications.
• Review with City staff and assigned committee members, Progress Sets of
Construction Documents at key intervals and identify all conflicts, suggested
revisions, additions or deletions, and construction material choices related to costs
• Finalize construction package based on comments.
• Assist HARP Foundation with Bidding and Negotiation Phase
• Assist HARP Foundation with contractor selection
4.0 Construction Administration
• Conduct periodic construction observation at key junctures during the
construction phase to reinforce design concept.
• Support CA duties by City Planning Staff.
• Conduct Pre -Final Walkthrough of project with Owner and Contractor to identify
punch list items requiring attention.
• Conduct Final Inspection to recommend Owner acceptance of project.
We assume an active and primary role during Construction Administration by the City of
Pueblo. This is due to our distant proximity to Pueblo and our lack of an on -site person
during the time of implementation. However, DSW will be on hand at key times dealing
with critical construction deadlines.

APPENDIX B
FEES:
The budget for construction is estimated to be $600,000 for the all of the specialized
program areas described above as the Boettcher Outdoor Education Center. Therefore
based on a percent of construction fee, Design Studios West, Inc. proposes a maximum
not to exceed fee of the following:
For all services through Construction Documents and bidding: $38,000.00
For potential specialized sub - consultants $ 6,000.00
For Construction Observation services: $ 3
For Architectural Sub - Consultant services: $13
Total for design and Construction Services: $60,000.00
