HomeMy WebLinkAbout09122RESOLUTION NO. 9122 A RESOLUTION APPROVING AMENDMENT NO. 1 TO THE AGREEMENT FOR PROFESSIONAL ARCHITECTURAL SERVICES BETWEEN THE FIRM OF ARCHITECTURE 2000, P.C., AND THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, RELATING TO PUEBLO MOUNTAIN PARK PRESERVATION /RESTORATION PROJECT AND AUTHORIZING THE PRESIDENT OF COUNCIL TO EXECUTE SAME WHEREAS, the City of Pueblo received a grant from the Colorado Historical Society to fund the Pueblo Mountain Park Preservation /Restoration Project - Phase I, II, and III, subject to the execution of a Contract; and WHEREAS, the firm of Architectural 2000, P.C. performed professional services for Phase I for this project; and WHEREAS, Amendment No. 1 will approve Architectural 2000, P.C. to continue providing architectural service, as outlined in the Phase I Agreement, for Phases II and III; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION I Amendment No. I to the Agreement for Professional Architectural Services, dated February 23, 1998, between the City of Pueblo, a Municipal Corporation, and Architecture 2000, P.C., of which a copy is attached hereto and on file at the office of the City Clerk, having been approved as to form by the City Attorney, is hereby approved. SECTION 2: The President of the City Council is hereby authorized to execute and deliver said Amendment No. 1, in the name of and on behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest same. SECTION 3 Funds for Phases I, II, and III shall not exceed a total of $75,400 for said professional services and paid from Account No. 260 - 9510- 600 -8050, Project No. PL9902. BACKGROUND: The City received a three year /three phase grant in the amount of $300,000 ($100,000 a year) from the Colorado Historical Society for restoration work in the Pueblo Mountain Park. The City will match the grant in the same amount each year. On January 26, 1997, City Council approved and entered into an agreement with the Colorado Historical Society for Phase I improvements. On February 23, 1998, the City approved an agreement authorizing the firm of Architectural 2000 P.C. to provide architectural services for Phase I - Pueblo Mountain Park Preservation /Restoration Project. Amendment No. I to the Agreement for Professional Architectural Services will amend the original Phase I Agreement and allow the Architectural 2000 P.C. firm to continue with providing architectural services relating to Phases II and III. RECOMMENDATION: Approval of the Resolution. FINANCIAL IMPACT: Funds shall not to exceed $75,400 for said professional services for Phases I, II and III, available from Account No. 260 -9510- 600 -8050, Project No. PL9902. AMENDMENT NO.1 AGREEMENT FOR PROFESSIONAL ARCHITECTURAL SERVICES THIS AMENDMENT NO. 1 t Agreement for Professional Architectural Services is made and entered in this 25th day of SP to _emhpr , 2000 by and between the City of Pueblo, a Municipal Corporation (hereinafter referred to as "Owner ") and Architecture 2000 P.C., (hereinafter referred to as "Architect "). WHEREAS, Owner and Architect have heretofore entered into an agreement dated February 23, 1998, (hereinafter "the Agreement "), wherein the Architect agreed to render certain professional architectural and related services for Owner in connection with the Pueblo Mountain Park Preservation /Restoration -Phase I Project (hereinafter referred to as the "Project "); and WHEREAS, it was the City of Pueblo's intent to engage the Architect for services rn connection with Phases I, II and III of the Pueblo Mountain Park Preservation /Restoration Project; and WHEREAS, the parties agree that Amendment to the Agreement is necessary and desirable to increase the contract amount for the performance of professional architectural services set forth in Section 1.1 of the Agreement for Phases I, of the Mountain Park Preservation /Restoration Project to include professional architectural services for Phases II and III. NOW, THEREFORE, in consideration of the foregoing and mutual terms and conditions set forth herein, the parties agree as follows: 1. The Agreement is amended by expanding the scope of work to include the additional services outlined in Appendix "A" to this Amendment. 2. The Architect shall complete the work items generally described in Appendix "A" to this Amendment in accordance with the terms of the Agreement. With respect to Architect's services provided under this Amendment, Appendix "B ", "Fee Schedule" of the original Agreement shall apply to compensation payable for key personnel, reimbursable expenses, and media costs for Phases II and III through final construction acceptance of the Project, and shall be increased to a total amount not to exceed $75,400 for the work authorized by the Agreement as amended by this Amendment No. 1. 4. Except as expressly modified by this Amendment, the Agreement shall remain in full force and effect. Any obligations remaining to performed under the original Agreement by either party, relating tot the professional services to be performed by the Architect generally or with respect to other phases of the Project are not waived or excused in any manner, but shall be fully performed in accordance Page 1 of 2 with the terms and conditions of the Agreement as it existed prior to this Amendment. Meier City of Pueblo Department of Planning and Development 211 East D Street Pueblo, CO 81003 August 10, 2000 Re: Pueblo Mountain Park Phases II and III Proposal for Professional Services Dear Steven, Architecture 2000 P.C. is pleased to submit this proposal for architectural and engineering services in connection with Phases II and III improvements to portions of the Lodge, Pavilion, entrance sign, and Ballfield at Pueblo Mountain Park. We have included design of the following items in our scope of work. Construction period services are included only for the Phase II tasks (everything except the Ballfield items). Horseshoe Lodge Center and east wings of porch: repairs to roof, posts, and east wing decking, similar to Phase I porch repairs scope. There will be no concrete ramp to the lower level needed, but there will be a sloped section from the porch floor to the east side dormitory floor similar to what was done in Phase I. Replace all door hardware with accessible hardware and panic hardware on exit doors. Replace gutters. Install illuminated exit signs. Some interior wood posts in crawlspace do not have footings. Some are resting on concrete but need to be attached with Simpson clips. Lodge / Pavilion area Restore outdoor amphitheater and stone stage. Restore stone site features (wishing well, flagpole base, fountains, etc.) Pavilion Replace portions of log railings. Park Main Entry: Eq - A4 ! Restore entrance sign. Fire Tower Stabilization of the Fire Tower will be described by a brief work write -up and photos of the structure. No design, drawings, or specifications will be prepared. Ballfield Grandstand (design only, no Phase III construction period services have been included) Repoint stone walls and stairs of grandstand and announcer's tower. Replace grandstand guardrails. Replace deteriorated portions of concrete paving on grandstand structure. Replace roof of Announcer's Tower. Splice log rafters on Announcer's Tower roof structure. Recondition window frames on Announcer's Tower. Add exterior door with lock. Restore interior flooring, spiral stairs, and stair rail inside Announcer's Tower. We have included reimbursable expenses related to the project, including coordination printing, xeroxing, long distance, and delivery charges. Duplication of bid documents is the responsibility of the City. Our understanding is that the documents will be bid publicly to general contractors. The work will be accomplished under one general contract. The scope of our work includes architectural, structural, and electrical design, and Phase II construction period services to include submittal review, change order preparation, and a maximum of 5 visits to the site during construction for meetings and / or site observations. Construction period services for Phase III work, if needed, will be negotiated at a later date. Architecture 2000 P.C. proposes to accomplish this work on a fixed fee basis as follows. We propose to subcontract structural engineering to JVA. Electrical engineering will be subcontracted to a professional engineering firm, not yet selected. 1.
