A RESOLUTION STATING OPPOSITION TO THE
PROPOSED CONSTITUTIONAL AMENDMENT 24
OTHERWISE KNOWN AS "CITIZEN MANAGEMENT OF
GROWTH"
WHEREAS, the proponents of Amendment 24 desire to amend the Colorado Constitution
by an initiated measure to appear on the November 7, 2000 state general election ballot; and
WHEREAS, Amendment 24 would prohibit any future subdivision or development of
land unless it is located in either a "committed area" or in a designated "growth area" approved
by the voters; and
WHEREAS, if Amendment 24 were approved, unless a valid development application
has been submitted to the City as of the date on which the ballot for the November election is
certified by the Secretary of State, a significant portion of the undeveloped property within the
City will no longer be able to be developed without the approval of the voters; and
WHEREAS, the process outlined in Amendment 24 for obtaining voter approval can best
be described as lengthy, complex, costly and uncertain; and
WHEREAS, Amendment 24 also contains numerous ambiguities that will undoubtedly
be the subject of extensive litigation if it passes; and
WHEREAS, Amendment 24 will thwart the process established by Pueblo citizens for
the development of the City in the City Charter; and
WHEREAS, the City Council is of the opinion that Amendment 24 is nothing more than
an attack upon fundamental principles of representative democracy that will effectively end the
growth- induced prosperity enjoyed by the citizens of the city of Pueblo and of this State over the
past decade; and
WHEREAS, the City Council finds and determines that the public interest requires it to
take formal action opposing Amendment 24, and
WHEREAS, the Colorado Fair Campaign Practices Act, at C.R.S. § 1-45 -
117(1)(b)(III)(A), authorizes the City's adoption of a resolution and the taking of a position of
advocacy on any issue pending before the electorate; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The City Council expresses its strong opposition to Amendment 24, otherwise known as
"Citizen Management of Growth," and the City Council urges its citizens to register to vote and
become thoroughly educated on the issues surrounding Amendment 24, the "Citizen
Management of Growth."
SECTION 2.
This resolution shall become effective upon final passage.
