HomeMy WebLinkAbout09073RESOLUTION NO. 9073 A RESOLUTION APPROVING A RENEWAL AGREEMENT FOR THE MANAGEMENT AGREEMENT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION AND THE SKY CORRAL R/C CLUB RELATING TO A RECREATIONAL MODEL AIRPLANE FACILITY AND AUTHORIZING THE PRESIDENT OF THE CITY COUNCIL TO EXECUTE THE SAME. BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: Section 1. The Renewal Agreement dated August 14 , 2000 for the Management Agreement between Sky Corral R/C Club and Pueblo, A Municipal Corporation, relating to a recreational model airplane facility developed on a portion of the "Honor Farm" property, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. Section 2. The President of the City Council is hereby authorized and directed to execute said Agreement for and on behalf of the City, and the City Clerk is directed to attest same and affix the seal of the City thereto. Issue: Should the City Council approve a Renewal Agreement for the Management Agreement with the Sky Corral R/C Club for use of certain land for a recreational model airplane facility located on property leased to the City by the State more commonly known as the Honor Farm. Background: The five year term management agreement between the City and the Sky Corral R/C Club for use of certain land on the Honor Farm property will expire on December 31, 2000. Sky Corral has the right, per the agreement, for first refusal and has requested that the agreement be renewed for a term of five (5) years from January 1, 2001 to December 31, 2005. The Club has had a management agreement with the City since 1982 for use of the described property. Correspondence from the State approving the renewal agreement, as required by the Honor Farm Lease Agreement, is attached. The Management Agreement and request from the Sky Corral R/C Club has also been attached as additional information. Financial Impact: The term of the renewal agreement is for five (5) years from January 1, ^001 co December 31, 2005 and they have first right of refusal. Sky Corral R/C Club is responsible for all improvements, utilities, insurance and liability associated with the property and its designated use. Recommendation: Approval of the Resolution. RENEWAL AGREEMENT THIS AGREEMENT entered into as of August 14 , 2000 by and between Pueblo, a municipal corporation "City ") and Sky Corral R/C Club ( "Manager "). WHEREAS, City and Manager entered into a Management Agreement dated January 1, 1996 relating to the use and management of a portion of the Honor Farm for the purposes of developing, operating and maintaining recreational model airplane facilities (the "Management Agreement "), and WHEREAS, Manager desires to renew the Management Agreement for a renewal term of five (5) years from January 1, 2001 to December 31, 2005, and WHEREAS, City is willing to renew the Management Agreement upon the terms and conditions herein contained. NOW, THEREFORE, in consideration of the foregoing and the following mutual covenants, City and Manager agree as follows: 1. The Management Agreement is hereby renewed upon the same covenants, conditions and provisions except the right of first refusal to renew contained in paragraph 3 thereof, for a renewal term of five (5) years from January 1, 2001 to December 31, 2005 unless sooner terminated and as provided in the Management Agreement. 2. If not in default under the Management Agreement, Manager shall have the right of first refusal to renew the Management Agreement upon such terms, covenants and conditions as Manager and City may then mutually agree. If Manager desires to renew the Management Agreement, Manager shall so notify City in writing on or before July 1, 2005. If Manager and City are unable for any reason to mutually agree upon the terms, covenants and conditions for such renewal by December 1, 2005, Manager's right of first refusal hereby granted shall cease and terminate and the terms of the Management Agreement shall expire December 31, 2005. 3. This Renewal Agreement is subject to approval by the Board of Parks and Outdoor Recreation and shall not become effective until after the date of such approval. 4. The Management Agreement and its covenants, conditions and provisions as renewed and modified by this Renewal Agreement shall remain in full force and effect during the five (5) year renewal term and shall inure to the benefit of and be binding upon the City and Manager and their respective successors and approved assigns. The members of Sky Corral Radio Control club hereby request a five -year extension of the lease agreement which was negotiated in 1995, as per the details of such agreement. Projects Completed During 1999 and January through June, 2000: The Sky Corral Radio Control Club arranged for professional resealing of the new paved 30' x 500` east -west runway which was installed in 1998. Cracks in the original east -west runway and the diagonal runway were dug out and properly filled and sealed, with Club members providing labor and using rented and donated heavy equipment. Funds for these projects were provided through the on- going runway fund and the generous donations of club members. The Club completed the construction of two additional sun shades in the pit area. Gravel was installed in this areas and in other areas requiring additional gravel and in extension of graveled areas to prevent erosion and muddy conditions. Additional work tables and benches were built by members and securely fastened to avoid theft. All areas were painted and new signs installed. A donated generator was installed to provide a needed power source during events. Income and Expenditures: The Sky Corral Radio Control Club collected approximately $3,000 in dues from members for the 2000 membership year. Other income may be collected from additional in -club fund raisers to be considered during the remainder of the year. The moneys are utilized for necessary club operations, to maintain our runways by purchasing materials to fill cracks, and for other necessary field maintenance. The largest portion of the funds have been and will be used for site maintenance and improvement. We contracted for weed control through Colorado Vegetation, Inc. at a cost of approximately $400. This project was completed in the spring of 2000. Club Activities: Flying activities include several sanctioned events, attracting participants from other communities and neighboring states. A regional Scale Masters Qualifier competition was held at Sky Corral Field on June 3-4, 2000. Competitors qualified to participate in the national Scale Masters Competition to be held later in the year. The competition at Sky Corral Field was the only one to be held in the Rocky Mountain area. Upcoming flying events scheduled to take place include the annual Surf -and -Turf Float Fly -in to be held July 15 -16, and a regional Pattern (precision aerobatic) competition to be held at Sky Corral Field on August 26 -27. Additional events may be scheduled. All competitive events are open to spectators. Other plans, in addition to our regular flying activities, include picnics, a Christmas party and participation in community events. Long -range Plans: Long -range plans call for continued maintenance of the runways and flight facilities which will include seal - coating on a regular schedule and addition of temporary improvements, as time and money is available. We will continue exploration of ways and means of raising additional funds in the current year. All decisions are made by a vote of the membership at regularly scheduled club meetings.
