A RESOLUTION AUTHORIZING THE TRANSFER OF REAL PROPERTY
AT 211 NORTH VICTORIA AVENUE TO THE STATE OF COLORADO,
STATE HISTORICAL SOCIETY OF COLORADO
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1
The Quit Claim Deed from Pueblo, a Municipal Corporation to the State of Colorado, State
Historical Society of Colorado, a copy of which is attached hereto and incorporated herein, having
been approved as to form by the City Attorney, is hereby approved.
SECTION 2:
The President of City Council is hereby authorized to execute and deliver the Quit Claim
Deed in the name of the City and the City Clerk is directed to affix the seal of the City thereto and
attest same.

ISSUE Should the City Council authorize the transfer of real property to the State of
Colorado, Colorado Historical Society for the El Pueblo Museum expansion project?
BACKGROUND The El Pueblo Site Development Master Plan has been completed. The
Project consists of the development of the entire block surrounded by First Street, Grand
Avenue Victoria Avenue, and Union Avenue. The development components include: expansion
of the museum; construction of an adobe trading post/fort; construction of an archaeology
pavilion; development of a park/plaza; and completion of right -of -way improvements.
The Museum Expansion Plans consists of the renovation of the existing El Pueblo museum and
the demolition of a City owned vacant building purchased from Edward P. Cassidy (The
Beanery) located at 211 North Victoria Avenue. The City of Pueblo acquired the building in
December 1998 with CDBG funds. Acquisition including relocation costs were approximately
$53,000.
A similar transfer of real property was performed when the present museum building was
deeded to the State for relocating El Pueblo museum to the downtown in early 1990's.
The timing of the transfer of this property to the State is critical and urgent to assure the start
of construction by November of this year.
Enclosed please find a copy of the Quit Claim Deed.
RECOMMENDATION Approval of the Resolution.
FINANCIAL IMPACT No financial impact is anticipated.

QUIT CLAIM DEED
THIS DEED, made this 14th day of August, 2000 between City of Pueblo, a Municipal
Corporation, of the first part, and State of Colorado, State Historical Society of Colorado, a
Colorado nonprofit corporation, of the second part,
WITNESSETH, That the said party of the first part, for and in consideration of the sum of
Ten Dollars ($10.00) to the said party of the first part in hand paid by the said party of the second
part, the receipt whereof is hereby confessed and acknowledged, hath remised, released, sold,
conveyed and QUIT CLAIMED, and by these presents doth remise, release, sell, convey and QUIT
CLAIM unto the said party of the second part, its successors and assigns forever, all of the right, title,
interest, claim and demand which the said party of the first part hath in and to the following described
real property situate, lying and being in the County of Pueblo and State of Colorado, to wit:
The East Ten (10) feet of the West Half of Lot Eight (8), Block Forty-Three (43), City of
Pueblo, County of Pueblo, State of Colorado.
commonly known as 211 N. Victoria, Pueblo, Colorado, 81003.
Documentary Fee - none, gift deed - consideration less than $500.00
TO HAVE AND TO HOLD the same, together with all and singular the appurtenances and
privileges thereunto belonging, or in anywise thereunto appertaining, and all the estate, right, title,
interest and claim whatsoever, of the said party of the first part, either in law or equity, to the only
proper use, benefit and behoof of said part of the second part, his heirs and assigns; provided that the
party of the first part conveys the above described real property to the party of the second part so
long as the real property is used exclusively and solely for a public museum or other public facility
in furtherance of the mission of the party of the second part, and no longer, and whenever the real
property ceases to be so used, the estate hereby granted will automatically terminate and title to the
real property will immediately revert to the first party, its successors and assigns. Grantee takes said
right, title and interest of said party of the first part subject to all liens, encroachments and
environmental conditions, including both those of record and those not of record.
IN WITNESS WHEREOF, The said party of the first part hath caused its corporate name to
be hereunto subscribed by the President of the City Council of Pueblo, and its corporate seal to be
hereunto affixed, attested by its City Clerk, the day and year first above written.
