RESOLUTION NO. 9022 A RESOLUTION AUTHORIZING A RELEASE OF EASEMENTS TO EL CENTRO PUEBLO DEVELOPMENT CORPORATION, INC., AS DEVELOPER AND OWNER OF OAKSHIRE HILLS SUBDIVISION BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: Section 1. The attached release of easements between Pueblo, a Municipal Corporation, and El Centro Pueblo Development Corporation, Inc., having been approved as to form by the City Attorney, is hereby approved. Section 2. The President of the City Council is hereby authorized and directed to execute such Release on behalf of the City of Pueblo. The City Clerk is directed to attest same and affix the seal of the City thereto and record the executed and acknowledged Release in the office of the Pueblo County Clerk and Recorder contemporaneously with the recording of the subdivision plat for Oakshire Hills subdivision. Section 3. This Resolution shall become effective upon final passage and approval. AS DEVELOPER AND OWNER OF OAKSHIRE HILLS SUBDIVISION DEPARTMENT: Public Works ISSUE DATE: May 22, 2000 Should the City Council authorize the release of easements and right of ways to El Centro Pueblo Development Corporation for the purpose of replat. RECOMMENDATION Approval of this Resolution BACKGROUND The easements were granted temporarily and were intended to exist until the subdivision of Oakshire Hills was submitted to the City for approval. Each and every easement will be dedicated on the plat of Oakshire Hills as either an easement or street right of way. Attached are copies of legal descriptions and drawings showing the locations of the easements to be released. Munoz 1 of 11 R 55.00 D 0.00 Pueblo Cty Clerk 8 Ree RELEASE OF EASEMENTS This release of easements is made on May 22 , 2000, by Pueblo, a Municipal Corporation (City), whose legal address is One City Hall Place, Pueblo, Colorado 81003, to El Centro Pueblo Development Corporation, Inc., a Non -Profit Corporation (Owner) of Pueblo, Colorado. WHEREAS, the Owner is the developer and property owner for the property known as Oakshire Hills subdivision according to the recorded plat thereof, and WHEREAS, the Owner is the Grantor and the City is the Grantee of the easements described in attached Exhibits "A," "B," and "C" for ingress, egress and public utility purposes easements across Owner's properties; and WHEREAS, the Owner has agreed to grant to the City of Pueblo alternate easements or rights of way for such purposes; and WHEREAS, the City and Owner desire to relocate such easements in and across Oakshire Hills subdivision. NOW THEREFORE in consideration of Owner granting certain easements and rights of way to the City of Pueblo on the plat of Oakshire Hills subdivision, the City hereby releases the easement described in attached Exhibits "A," "B," and "C."
