A RESOLUTION APPROVING A QUIT CLAIM DEED CONVEYING
REAL PROPERTY (OAKSHIRE LANE) TO EL CENTRO PUEBLO
DEVELOPMENT CORPORATION FORPURPOSE OF REPLATTING
LAND AND AUTHORIZING THE PRESIDENT OF THE CITY

BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO that:
Section 1
The Quit Claim Deed conveying title of real property to El Centro Pueblo Development, a copy of which
is attached hereto, having been approved as to form by the City Attorney, is hereby approved.
Section 2.
The President of the City Council is authorized to execute and deliver the Quit Claim Deed in
the name of the City. The City Clerk is directed to affix the seal of the City thereto, attest same and to
cause said Deed to be recorded in the office of the Pueblo County Clerk and Recorder.

Should the City Council approve the reconveyance of real property to El Centro Pueblo Development
Corporation for replat purposes and future city development.
RECOMMENDATION
Approval of this Resolution
BACKGROUND
El Centro Pueblo Development Corporation requests that the City of Pueblo reconvey the right of way
for Oakshire Ln that was previously conveyed to the City in order that the right of way maybe dedicated
as part of the replatting of Oakshire Hills subdivision.
FINANCIAL IMPACT
There is no financial impact upon the City due to this action

QUIT CLAIM DEED
THIS DEED, made this 27th day of Apri 1
City of Pueblo, a Municipal Corporation, of the first part, and
of the second part,

WITNESSETH, That the said party of the first part, for and in consideration of the sum of
Ten Dollars ($10.00) to the said party of the first part in hand paid by the said party of the second
part, the receipt whereof is hereby confessed and acknowledged, hath remised, released, sold,
conveyed and QUIT CLAIMED, and by these presents doth remise, release, sell, convey and QUIT
CLAIM unto the said party of the second part, its successors and assigns forever, all of the right,
title, interest, claim and demand which the said party of the first part hath in and to the following
described real property situate, lying and being in the County of Pueblo and State of Colorado, to
wit:

TO HAVE AND TO HOLD the same, together with all and singular the appurtenances and
privileges thereunto belonging, or in anywise thereunto appertaining, and all the estate, right, title,
interest and claim whatsoever, of the said party of the first part, either in law or equity, to the only
proper use, benefit and behoof of said part of the second part, his heirs and assigns forever. Grantee
takes said right, title and interest of said party of the first part subject to all liens, encroachments,
leases and environmental conditions, including both those of record and those not of record.
IN WITNESS WHEREOF, Tlie said party of the first part hath caused its corporate name to
be hereunto subscribed by the President of the City Council of Pueblo, and its corporate seal to be
hereunto affixed, attested by its City Clerk, the day and year first above written.

A street right -of -way through a portion of Lot 1, 81ock 1 and
through a portion of oakshire Lane, as platted in Oakshire Mobile
Home Estates, according to the recorded plat thereof, filed for
record September 14, 1990, being 80 feet in width, 40 feet on each
side of the following described centerline:
Considering the East boundary line of said oakshire Mobile Home
Estates to bear S.00 °53'56 "E. and all bearings contained herein
being relative thereto.
Beginning at the intersection of the West boundary line of said
oakshire Mobile Home Estates and the centerline of said oakshire
Lane; thence S.T9 ° 19'52 "E., a distance of 719.95 feet; thence
Southeasterly, along the arc of a curve to the right whose radius
is 350 feet, a distance of 198.31 feet; thence S.47 ° 56'47 "E., a
distance of 115.30 feet; thence Southeasterly, along the arc of a
