RESOLUTION NO. 8839 A RESOLUTION AUTHORIZING A RELEASE OF AN EASEMENT FOR PERRY AVENUE TO CLAYTON STREET PROPERTIES, L.L.C. AS DEVELOPER AND OWNER OF WEST VALLEY ESTATES SUBDIVISION BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: Section 1. The attached release of easement between Pueblo, a Municipal Corporation, and Clayton Street Properties, L.L.C., having been approved as to form by the City Attorney, is hereby approved. Section 2. The President of the City Council is hereby authorized and directed to execute such Release on behalf of the City of Pueblo. The City Clerk is directed to attest same and affix the seal of the city thereto. Section 3. This Resolution shall become effective upon final passage and approval. RECOMMENDATION Approval of this Resolution BACKGROUND With the platting of West Valley Estates Subdivision, a temporary roadway easement for the extension of Perry Avenue to W. 24 Street is no longer needed. The easement will be replaced with the dedication of Public Right -Of -Way on this plat for the extension of Perry Avenue. RELEASE OF EASEMENT This release of easement is made on October 12, 1999, by Pueblo, a Municipal Corporation (City), whose legal address is One City Hall Place, Pueblo, Colorado 81003, to Clayton Street Properties, L.L.C., A Colorado Limited Liability Company (Owner). WHEREAS, the Owner of a parcel of land described in documents filed for record October 31, 1986, in Book 2314 at Pages 238 and 239 and recorded again on January 11, 1992, in Book 2574 at Pages 546 and 547 in the records of the Pueblo County Clerk and Recorder, being more particularly described as follows: 'A parcel of land 60 feet wide, being 30 feet on each side of the following described centerline: Beginning at the point of intersection of the North property line of W. 23` Street and the centerline of Perry Avenue as shown on the recorded plat of Sanders Subdivision; thence N 0° 23' 30" and along said centerline extended, a distance of 440.99 to the South property line of W. 24` Street. Said parcel of land contains .607 acres more or less' wishes to develop this property; and WHEREAS, the Owner is the Grantor and the City is the Grantee, of an easement described in Book 2314, Pages 238 and 239 and Book 2574, Pages 546 and 547 of the Pueblo County Records, for the purpose of a temporary roadway, known as Perry Ave., across the property; and WHEREAS, the Owners has agreed to dedicate a Public Right -Of -Way for such purposes on the plat of WEST VALLEY ESTATES SUBDIVISION; and NOW THEREFORE, in consideration of the Owner dedicating a Public Right -Of -Way on the plat of WEST VALLEY ESTATES SUBDIVISION, the City hereby releases the easement described in Book 2314, Pages 238 and 239 and Book 2574, Pages 546 and 547 of the Pueblo County Records.
