HomeMy WebLinkAbout8779RESOLUTION NO. 8779 A RESOLUTION SUBMITTING TO THE REGISTERED ELECTORS OF THE CITY OF PUEBLO AT THE GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 2, 1999 A MEASURE RELATING TO REVENUE AND SPENDING CHANGES AND TEMPORARY REDUCTION OF THE CITY'S SALES TAX RATE, AND FIXING THE BALLOT TITLE THEREFOR WHEREAS, an initiative petition having the required number of signatures has been filed with the City Clerk requesting that a measure relating to revenue and spending changes and temporary reduction of the City's sales tax rate (the "Measure ") be submitted to a vote of the registered electors of the City of Pueblo at the general municipal election to be held on Tuesday, November 2, 1999, and WHEREAS, pursuant to section 5 -1 -10 of the Pueblo Municipal Code, the City Council shall fix the ballot title for such initiative Measure which will fairly express the true meaning and intent thereof. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: RRC'TInN 1 The Measure shall be and is hereby submitted to a vote of the registered electors of the City of Pueblo at the general municipal election to be held on Tuesday, November 2, 1999. SECTION 2. The ballot title for the Measure is hereby fixed to read as follows: CITY OF PUEBLO BALLOT TITLE NO. 1 CONTINGENT UPON FORMATION OF THE PUEBLO SCIENTIFIC AND CULTURAL FACILITIES DISTRICT BY VOTER APPROVAL AT THE NOVEMBER 2, 1999 GENERAL ELECTION, SHALL THE CITY OF PUEBLO BE AUTHORIZED TO COLLECT, RETAIN AND SPEND ANNUALLY FOR A PERIOD OF FIVE YEARS (COMMENCING JANUARY 1, 2000 AND ENDING DECEMBER 31, 2004), WITHOUT LIMITATION OR CONDITION, AN AMOUNT IN EXCESS OF ITS OTHERWISE APPLICABLE ANNUAL REVENUE AND SPENDING LIMITS UNDER ARTICLE X, SECTION 20 OF THE COLORADO CONSTITUTION AND ANY OTHER LAW, AS A VOTER APPROVED REVENUE CHANGE AND AN EXCEPTION TO SAID SPENDING LIMIT, IN ADDITION TO ALL OTHER AMOUNTS ALLOWED BY LAW OR HERETOFORE VOTER APPROVED, EQUAL TO $2,000,000 OR FIFTEEN ONE HUNDREDTHS PERCENT (0.15 %) OF THE AMOUNT OF ALL TAXABLE SALES OF COMMODITIES AND SERVICES, WHICHEVER IS LESS; AND IN CONNECTION THEREWITH SHALL THE CITY'S SALES TAX RATE BE TEMPORARILY REDUCED BY FIFTEEN ONE HUNDREDTHS OF ONE PERCENT (0.15 %) FOR A PERIOD OF FIVE YEARS (COMMENCING JANUARY 1, 2000 AND ENDING DECEMBER 31, 2004) AND THEREAFTER BE INCREASED TO ITS CURRENT RATE OF THREE PERCENT (3 %) IN ADDITION TO ANY SALES TAX RATE IMPOSED FOR JOB CREATING CAPITAL IMPROVEMENT PROJECTS? YES NO SECTION 3 The City Council does hereby find, determine and declare that the ballot title set forth in Section 2 hereof fairly expresses the true meaning and intent of the Measure. SECTION 4 The City Clerk shall (a) at least ten (10) days prior to the November 2, 1999 general municipal election publish notice of an election upon the Measure, which notice shall contain the full text of the Measure, and (b) certify the Ballot Title to the Pueblo County Clerk and Recorder by the fifty -fifth day prior to the November 2, 1999 coordinated election as provided in section 1 -5- 203(3), C.R.S. SECTION 5 This Resolution shall become effective upon final passage.
