Larry G. Moore was appointed to the Board as the Electrical Utility Employee and should have been considered for the Journeyman position. This Resolution corrects the appointments as follows: Larry G. Moore Journeyman Elmo F. Bailey Electric Utility Employee for terms expiring July 1, 2002. Correspondence regarding this issue and questionnaires for both individuals are attached for reference. [ D Sao City of Pueblo OFFICE OF THE CITY ATTORNEY 127 Thatcher Building MEMORANDUM PUEBLO, COLORADO 81003 TO: Gina Dutcher, City Clerk FROM: City Attorney RE: Electrical Board of Appeals DATE: July 27, 1999 Based upon the correspondence forwarded to me today by your office, it appears that the confusion in appointing members to the Electrical Board of Appeals (the "Appeals Board ") by Resolution No. 8733 on June 28, 1999 including the failure to consider the application of Larry Moore for appointment as the Journeyman member on the Appeals Board but appointing him as the Electrical Utility Employee member for which he is not qualified casts serious doubt on the validity of the appointments. We would recommend that the appointment of Jeffrey S. Stevens as the Journeyman member of the Appeals Board and the appointment of Larry Moore as the Electrical Utility Employee member be vacated and that the appointments of the Electrical Utility Employee member and Journeyman member be reconsidered by the City Council and Board of County Commissioners. Both vacating and appointing may be done in a single resolution, a draft of which is attached. If you have any questions, please call me. Very truly yours, e o sm ` e enc. s ` MEMORANDUM TO: Mr. Jagger FROM: Gina Dutcher oi� DATE: July 26, 1999 SUBJECT: Electrical Board of Review Following the June PACOG Meeting, the City Council and the County Commissioners came to an agreement for appointments to the various Boards of Appeal; however, an error was made with the appointments to the Electrical Board of Appeals. Both governmental entities have followed the appointments up by Resolution. The Council and Commissioners appointed Mr. Larry Moore to fill the position for the Electric Utility Employee (Utility Company Engineer or Journeyman Electrician) instead of re- appointing him to his previous Journeyman position. Mr. Moore has served on the Electrical Board for numerous years, but he is not an employee of any local electric utility company. He specifically asked to be considered for reappointment to the Board in the Journeyman position, but the Journeyman appointment was given to a gentleman named Jeffrey Stevens. During a conversation with Clint Tawse, I told him I did not think the appointment of Jeffrey Stevens could be "un- done;" however, we would re- advertise and take the necessary steps to fill the position for the Electric Utility Employee. Following this discussion, I received a letter from the International Brotherhood of Electrical Workers, Local #12 explaining that they feel Mr. Moore's application, to be reconsidered as a Journeyman member of the board, was not given due consideration. They are requesting that the appointment of the Journeyman's position be reconsidered along with the position for the Electric Utility Employee. Mr. Elmo F. Bailey, who asked to be re- appointed to the Electric Utility Employee position and was not appointed, has submitted a new questionnaire to be considered for reappointment to this position. Could you please provide direction? Does the error that was made by considering Mr. Moore for the incorrect position on the board constitute cause to reverse the current appointments and begin the process over for new appointments for all positions on this particular board? Mr. Moore has served the Electrical board for many years and is an excellent Electrical Contractor, but he is not an employee of any local electric utility. Th reason for this specific post is so the Department and members of the Electrical Board can have input on current issues in the fast changing electrical utility field. I would further suggest that Council reconsider reinstating Mr. Moore to his seat as a Journeyman /Master Electrician. His experience and knowledge is invaluable to the Board in that position. If Council would like me to come before them to clarify this rror, I am at their beckoned call. While it is obvious that Mr. Larry Moore is not qualified to serve as a utility representative, he has demonstrated the ability to be a fair and committed member of the Board. Mr. Moore is not a member of our organization, nor is he affiliated with us in anv way. But we have been impressed with his commitment to ensuring the public's health and safety, and with the knowledge of the industry that he has accumulated through his many years of service. Mr. Moore s application to be reconsidered as a Joumevman member of the board was not given due consideration. and we believe that the only fair way to rectify this problem would be by reconsidering appointment of the Journeyman's position as well. We, the undersigned, possess a cumulative total of nearly 40 years experience in the electrical trade; working in the field, as a shop owner and most recently representing over 300 Southern Colorado electricians working for over 30 contractors.
