A RESOLUTION ACCEPTING A QUITCLAIM DEED
FROM THE UNITED STATES OF AMERICA WITHOUT
IMPOSING ANY OBLIGATION ON THE CITY TO
MAINTAIN, REPAIR OR SERVICE ANY ROAD OR
RIGHT OF WAY OR LAND THEREIN DESCRIBED
WHEREAS, the United States of America by quitclaim deed conveyed to the City of Pueblo
certain land and rights of way acquired for the relocation of modified county roads in connection
with the relocation of the Denver and Rio Grande Western Railroad around Pueblo Dam and
Reservoir, which were located within areas annexed to the City, and
WHEREAS, such quitclaim deed has not been accepted by the City, and
WHEREAS, it would be appropriate for the City to accept such quitclaim deed. Now
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
Section 1.
The Quitclaim Deed dated August 30, 1982 between the United States of America and
Pueblo, a Municipal Corporation, recorded September 8, 1982 in Book 2126, Page 813 as
Instrument No. 700008 in the records of the Pueblo County Clerk and Recorder is hereby accepted,
without however, imposing any obligation or liability on the City to operate, install, construct,
maintain, repair or service any of the roads, rights -of -way, or land therein described; such
obligations and liabilities being hereby specifically rejected.

This Quitclaim Deed made this 30th day of August , 1982,
between THE UNITED STATES OF AMERICA acting by and through the duly
authorized Regional Director, Lower Missouri Region, Bureau of Reclamation,
pursuant to the Act of Congress of June 17, 1902 (32 Stat. 388), and acts
amendatory thereof or supplementary thereto, hereinafter termed the United
States, and PUEBLO, a Municipal Corporation, hereinafter termed the City.
WITNESSETH, That the United States, in consideration of the provisions
of that one certain contract between the United States and Pueblo County,
Colorado, hereto designated Contract No. 14 -06- 700 -6356 dated July 6, 1967,
for the relocation and /or modification of certain county roads in connection_
with the relocation of the Denver and Rio Grande Western Railroad around
Pueblo Dam and Reservoir, has granted, conveyed, remised, released, and
quitclaimed and by these presents does grant, convey, remise, release, and
quitclaim unto the City, its successors and assigns, as successor in title
to Pueblo County, Colorado, pursuant to Article 12 of the above referenced
contract, forever, all right, title, claim, interest, estate, and demand
both at law and in equity of lands situated in Pueblo County, State of
Colorado, more particularly described in the legal descriptions attached
hereto and by this reference made a part hereof and designated as follows:
Tract No. 395, Parcels A, B, C, D, E, F, G, H, I, J, K, L, M, N,
and 0.
TOGETHER with all the right, title, and interest of the United States
in and to any alleys, streets, ways, strips, or gores abutting or adjoining
the land.
TOGETHER with all and singular the hereditaments and appurtenances
thereunto belonging or in anywise appertaining, and all the.estate, right,
title, interest, and claim whatsoever, of the United States, either in law
or equity, unto the City, its successors and assigns, forever.
IN WITNESS WHEREOF the United States has caused the execution and
delivery of this instrument the day and year first above written.
