HomeMy WebLinkAbout8597RESOLUTION NO. 8597 A RESOLUTION ADOPTING THE 1998 CITY OF PUEBLO ANNEXATION MASTER PLAN AS THE THREE -MILE AREA PLAN FOR THE CITY OF PUEBLO, PURSUANT TO THE MUNICIPAL ANNEXATION ACT OF 1965 WHEREAS, the City Planning and Zoning Commission is authorized to prepare and submit to the City Council for its approval a master plan for the physical development of the City, pursuant to Section 12 -5 of the Charter of Pueblo; and WHEREAS, the City Planning and Zoning Commission, in compliance with the Municipal Annexation Act of 1965 (Section 31- 12- 105[1][E], CRS [1988 Cum. Supp.]), has approved a three -mile area plan for the City (1996 City of Pueblo Annexation Master Plan); BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO that: SECTION 1 The 1998 City of Pueblo Annexation Master Plan heretofore approved by the City Planning and Zoning Commission and submitted to the City Council, the original of which is on file in the office of the City Clerk, is hereby approved. SECTION 2 The 1998 City of Pueblo Annexation Master Plan is hereby adopted and shall function as the City of Pueblo's official "three -mile area plan," as required by Section 31- 12- 105(1)(e), CRS (1988 Cum. Supp.) for the City of Pueblo; said plan shall be updated at least annually. SECTION 3 All three -mile area plans and all parts thereof City are hereby repealed and rescinded, except approved pursuant thereto by the City or by any SECTION 4 heretofore adopted by the City Council for the insofar as any physical development has been of its agencies, commissions, or boards. This Resolution shall become effective upon final passage. BACKGROUND Senate Bill 45 requires that "prior to completion of any annexation within the three -mile area, the municipality shall have in place a plan for that area which generally describes the proposed location, character, and extent of streets, subways, bridges, waterways, waterfronts, . parkways, playgrounds, squares, parks, aviation fields, other public ways, grounds, open spaces, public utilities, and terminals for water, light, sanitation, transportation, and power to be provided by the municipality and the proposed land uses for the area. Such plan shall be updated at least once annually." The 1998 City of Pueblo Annexation Master Plan meets the intent of the State legislation. The Pueblo City Council adopted the Pueblo Regional Comprehensive Develop- ment Plan as the Three -Mile Area Plan for the community in 1988. The Northeast, Southeast, Southwest, and Northwest Quadrant Annexation Master Plans, as adopted in 1989, replaced the Comprehensive Plan as the Three -Mile Area Plan for the City of Pueblo. In 1993, City of Pueblo combined all previous plans into a single document. The Plan has since been updated and adopted annually. If adopted, the 1998 Plan shall replace the 1997 Plan. The primary changes in the 1998 Plan are updated school enrollment figures and an appendix summarizing 1998 annexation activities. Copies of all changes are being provided.
