FOR OVERSIZING A SANITARY SEWER MAIN FOR SOUTHGATE AT PUEBLO SUBDIVISION, FILING NO. 1 WHEREAS, the City of Pueblo Wastewater Department collects Sanitary Sewer Connection Fees for all new connections and enlargements of existing connections made to the City of Pueblo's sanitary sewer system; and WHEREAS, the revenue received by the City from the sanitary sewer connection fees is deposited into a special fund to be used for growth related capital projects; and WHEREAS, the City's Wastewater Department required Comanche Corp. to oversize a sanitary sewer main for Southgate at Pueblo Subdivision, Filing No. 1; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1 The City of Pueblo shall reimburse Comanche Corp. the sum of $21,129.64 for oversizing the sanitary sewer main along Lake Avenue in said subdivision, in accordance with the Sanitary Sewer System - General Policies adopted by Resolution No. 7379. SECTION 9 Such a reimbursement shall be paid through the Sewer Utility Fund, Account Number 014 - 0400437- 000 -030 -0031 and then credited from the Sanitary Sewer Collection System. Improvement Fund account 014 - 009 - 500 -1787, by the Director of Finance. SECTION 3. This Resolution shall become effective immediately upon final approval. FOR OVERSIZING A SANITARY SEWER MAIN FOR SOUTHGATE AT PUEBLO SUBDIVISION FILING NO. 1 Department: WASTEWATER DEPARTMENT Date: DECEMBER 14, 1998 ISSUE Should the City of Pueblo approve a resolution authorizing reimbursement for oversizing a sanitary sewer main. RECOMMENDATION Approval of the Resolution. BACKGROUND In 1994 the City of Pueblo adopted an ordinance assessing a fee for all new connections and enlargements of existing connections, made to the City's sanitary sewer system. The revenue from the connection fees are deposited into a special fund (Sanitary Sewer Collection System Improvement Fund). No expenditures from the fund shall be made except for growth related capital projects. Comanche Corp. recently installed a sanitary sewer main to serve Southgate at Pueblo Subdivision, Filing No. 1. Although an eight inch (8 ") main would accommodate the subdivision, the City required the developer to install a twenty -four inch (24 ") sewer along Lake Avenue which will also serve the area to the south. Along with the ordinance adopting the sanitary sewer connection fees the City adopted a resolution regarding "Sanitary Sewer System - General Policies." The policies addressed sewer main extensions, relief sewers and oversizing. According to the policy, the City will reimburse the developer for oversizing the sanitary sewer system not required to serve the subdivision based on specific criteria. Comanche Corp. has met all of the criteria and is therefore eligible for reimbursement for oversizing the main along Lake Avenue. FINANCIAL IMPACT The reimbursement of $21,129.64 will be paid through the Sewer Utility Fund, Account Number 014 - 0400 -437- 000 - 030 -0031 and then credited from the SSCF account 014- 009- 500 -1787
