A RESOLUTION AUTHORIZING A RELEASE OF EASEMENT TO EL
CENTRO PUEBLO DEVELOPMENT CORPORATION Inc. AS
DEVELOPER AND OWNER OF OAKSHIRE MOBILE HOME
ESTATES SUBDIVISION
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
Section 1
The attached release of easement between Pueblo, a Municipal Corporation, and El
Centro Development Corporation Inc., having been approved as to form by the City Attorney, is
hereby approved.
Section 2
The president of the City Council is hereby authorized and directed to execute such
Release on behalf of the City of Pueblo. The City Clerk is directed to attest same and affix the
seal of the City thereto
Section 3.
This Resolution shall become effective upon passage and approval.

Should the City Council authorize a release of easement to El Centro Pueblo Development
Corporation Inc., so the property formerly known as Oakshire Mobile Home Estates Subdivision can
be redeveloped.
RECOMMENDATION
Approval of this Resolution
BACKGROUND
The developer wishes to resubdivide a portion of their property known as Oakshire Mobile Home
Estates Subdivision. The roadways have been previously vacated but there remains an existing
drainage and sanitary easement along the south edge of the property. They also wish to vacate
an easement granted to the City for a future street to be known as Chase St. These easements
will be replaced with dedicated easements and right -of -way on the resubdivision plat to be known
as Trinity Life Subdivision.
FINANCIAL IMPACT
There is no financial impact upon the City due to this action.

RELEASE OF EASEMENTS
This release of easements is made on September 28, 1998, by PUEBLO, A MUNICIPAL
CORPORATION (City), whose legal address is One City Hall Place, Pueblo, Colorado, 81003, to EL CENTRO
PUEBLO DEVELOPMENT CORPORATION, Inc. (Owners).
WHEREAS, the Owners are developing or re- developing the property formerly known as Oakshire
Mobile Home Estates according to the plat thereof, and wish to change the existing easements within the
property, and
WHEREAS, the City is the Grantee of an easement within this property for Sanitary Sewer and Drainage
purposes as recorded in Book 3087, Page 362 and an easement for public utility purposes as recorded in Book
3087, Page 353, of the records of the Pueblo County Clerk and Recorder.
NOW THEREFORE in consideration of the foregoing, the City hereby releases and vacates that portion
of the � s is as described in attached Exhibit "A ".

EXHIBIT "A"
The City agrees to release the westerly 630.80 feet of an easement recorded in Book 3087, Page 362 of the
Pueblo County records, for Sanitary Sewer and Drainage purposes, more particularly described as follows:
BEGINNING at the southwest comer of Lot 1, Block 2, of OAKSHIRE MOBILE HOME ESTATES, according
to the plat filed for record on September 14, 1990, thence easterly along the south subdivision line a distance
of 630.80 feet, said easement being 43 feet in width and lying north of and immediately adjacent to the south
subdivision line.
The City agrees to release all the public utility easement recorded in Book 3087, Page 353, Easement No.
5 as described in Exhibit "A ", of the Pueblo County records more particularly described as an easement for
public utility purposes through a portion of Oakshire Mobile Home Estates, according to the recorded plat
thereof, filed for record September 14, 1990, being 60 feet in width, 30 feet on each side of the following
described centerline:
Considering the east subdivision boundary of said Oakshire Mobile Home Estates to bear S 00 53'56 E
and all bearings contained herein being relative thereto.
Commencing at the intersection of the west subdivision boundary line with the centerline of the right -of -way
of Oakshire Lane, as conveyed to the City of Pueblo by deed recorded in Book 2901, Page 71, of the Pueblo
County records; thence S 79° 19' 52" E , along said centerline, a distance of 529.67 feet to the True Point
of Beginning of the easement line herein described; thence S 10 40' 08" W, a distance of 142.83 feet;
thence southerly, along the arc of a curve to the left whose radius is 500 feet, a distance of 99.41 feet;
thence S 00 43'20" E, a distance of 102.98 feet to the south subdivision boundary line and the Point of
Terminus.
