HomeMy WebLinkAbout8259RESOLUTION NO. 8259 A RESOLUTION APPROVING AND ACCEPTING SUPPLEMENTAL AWARD 95CCWX0501 FROM THE UNITED STATES DEPARTMENT OF JUSTICE AND APPLICABLE CONDITIONS PERTAINING THERETO AND AUTHORIZING THE PRESIDENT OF THE CITY COUNCIL TO EXECUTE SAME WHEREAS, the City Council of Pueblo has the authority on behalf of the City of Pueblo, including its Police Department, to accept grants from the federal government for public and municipal purposes and to enter into agreements relating thereto; and WHEREAS, the City has previously received federal funds from the United States Department of Justice ( "DOY) under COPS Grant Award No. 95CCWX0501 dated April 1, 1995 and Supplemental Award dated April 1, 1997 for municipal law enforcement purposes; and WHEREAS, DOJ has tendered a COPS Universal Hiring Supplemental Award, No. 95CCWX0501 dated September 25, 1997 (" 1997 Supplemental Award ") in the additional amount of $450,000 upon conditions, including but not limited to expenditure by the City of $387,390 in local matching funds; and WHEREAS, the obligations of the City under the 1997 Supplemental Award will require appropriations in multiple fiscal years; and WHEREAS, the 1997 Supplemental Award requires participation by the City for multiple fiscal years and this Resolution is intended to approve such participation of the City for multiple fiscal years subject to the availability of federal funding for the 1998 and subsequent fiscal years and subject to and contingent upon City appropriations therefor for any future fiscal year obligations by City; and WHEREAS, acceptance of the 1997 Supplemental Award will result in the post- acceptance hiring of 6 additional police officers in the classified service of the City and thereby benefit the health, welfare and safety of the citizens of the City; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 The 1997 Supplemental Award dated September 25, 1997 to the City of Pueblo, a true copy of which is attached hereto, is hereby accepted in accordance with its terms and conditions and is approved subject to unencumbered appropriations being available therefor in the 1997 budget, and further subject to and contingent upon appropriations being made therefor in the 1998 and subsequent years budgets. SECTION 2 The President of the City Council is authorized to execute the 1997 Supplemental Award in the name of and on behalf of the City, and the City Clerk is directed to affix the seal of the City thereto and attest same. The funding under this Universal Hiring Program Supplemental Grant Award may only be used for the payment of the approved salaries and benefits of those additional, newly hired officers funded under your agency's Universal Hiring Program Supplemental Grant Award. Unless approved in writing by the COPS Office, the funding under this Supplemental Grant Award may not be applied to officers hired before the Supplemental Grant Award Start Date printed on the reverse side. In addition, the funding may not be used to hire officers to fill current vacancies for which local funding is available. 2. Your agency remains subject to the same terms and conditions as were set forth in the original FAST, AHEAD, or UHP Award. 3. Your agency agrees to complete and keep on file, as appropriate, an Immigration and Naturalization Service Employment Eligibility Verification Form (I -9). This form is to be used by recipients of federal funds to verify that persons are eligible to work in the United States.
