A RESOLUTION ACCEPTING A SIDEWALK EASEMENT FROM
DANIEL AND PAULA KAWAJI
WHEREAS, DANIEL AND PAULA KAWAJI, on Aug. 13th, 1997, granted an easement to
the City of Pueblo;
and
WHEREAS, such easement is necessary to construct a pedestrian sidewalk across a
portion of the property located at 527 Melbourne, and has been approved as to form by the City
Attorney;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO,
that:
Section 1
The easement granted by DANIEL AND PAULA KAWAJI, dated Aug. 13th, 1997, which
easement is on file with the City Clerk, is hereby approved and accepted.
Section 2
The City Clerk is directed to record said easement in the office of the Pueblo County Clerk
and Recorder.

SIDEWALK EASEMENT
THIS EASEMENT, granted this 13th day of August, 1997 , by
Daniel Kawaji & Paula Kawaji , Grantor, to the CITY OF PUEBLO, a
Municipal Corporation, Grantee:
WITNESSETH:
TI-.AT FOR AND ENT CONSIDERATION of the sum of One Dollar ($1.00) and other good and
valuable consideration, paid by Grantee, receipt of which is hereby. acknowledged, Grantor hereby grants
to Grantee, its successors and assigns, an easement for the purpose of public sidewalk, in, through, over,
under and across Grantor's property situated in Pueblo County, Colorado, commonly known as 527
Melbourne Street , and described as follows:
The easterly four feet (4) of the north 80' of Lot 3, Block 2, W.D.B. Land Company Subdivision, Filing
No. 3, according to the recorded plat filed for record December, 1949, in Book 14A, Page 5, of the Pueblo
County Records.
TOGETHER WITH the right to enter upon said property for the purpose of construction,
maintenance, control, and repair, and together with the right to use so much of the adjoining property of
Grantor that may be reasonably necessary during the period of initial construction for said purposes. The
Grantor reserves the right to use and occupy said property for any purpose consistent with the right and
privilege above granted and which will not interfere with or endanger any of the Grantee's equipment or
facilities therein or use thereof. Such reservation by the Grantor shall in no event include the right to
locate or erect or cause to be located or erected any building or any other structure or mobile home trailer
unit upon the easement herein granted.
"Grantor" shall include the plural and the feminine. This easement shall be binding upon, and shall
inure to the benefit of the heirs, personal representatives, successors, or assigns of the Grantor and
Grantee.
