A RESOLUTION ACCEPTING A SIDEWALK EASEMENT FROM
MARIA AND ERNEST DEHERRERA AND PHOEBE MARTINEZ
WHEREAS, MARIA AND ERNEST DEHERRERA AND PHOEBE MARTINEZ, on Feb. 19th,
1997, granted an easement to the City of Pueblo;
and
WHEREAS, such easement is necessary to construct a pedestrian sidewalk across a
portion of the property located at 2732 E. 16th St., and has been approved as to form by the City
Attorney;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO,
that:
Section 1
The easement granted by MARIA AND ERNEST DEHERRERA AND PHOEBE MARTINEZ,
dated Feb 19th, 1997, which easement is on file with the City Clerk, is hereby approved and
accepted.
Section 2
The City Clerk is directed to record said easement in the office of the Pueblo County Clerk
and Recorder.

SIDEWALK EASEMENT
THIS EASEMENT, granted this Iq t-L day of February, 1997 _ , by
MARTA & ERNEST DeHERRERA & PHOEBE MARTINEZ , Grantor, to the
CITY OF PUEBLO, a Municipal Corporation, Grantee:
WITNESSETH:
THAT FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) and other good and
valuable consideration, paid by Grantee, receipt of which is hereby acknowledged, Grantor hereby grants
to Grantee, its successors and assigns, an easement for the purpose of public sidewalk, in, through, over,
under and across Grantor's property situated in Pueblo County, Colorado, commonly known as
2732 East 16th St. , and described as follows:
A triangular easement located in the Northeast corner of Lot 8, Block 2, James Addition, according to the
recorded plat filed for record September 25, 1952, in Book 16, Page 7, of the Pueblo County Records,
being more particularly described as follows:
Beginning at the Northeast corner of said Lot 8 (said point also being the intersection point of the west
right -of -way line for Clovis Avenue and the south right -of -way line for East 16th Street); thence Southerly
along the east lot line a distance of 7.0 feet; thence Northwesterly a distance of 9.9 feet more or less to a
point along the north lot line of said lot; thence Easterly a distance of 7.0 feet to the point of beginning.
TOGETHER WITH the right to enter upon said property for the purpose of construction,
maintenance, control, and repair, and together with the right to use so much of the adjoining property of
Grantor that may be reasonably necessary during the period of initial construction for said purposes. The
Grantor reserves the right to use and occupy said property for any purpose consistent with the right and
privilege above granted and which will not interfere with or endanger any of the Grantee's equipment or
facilities therein or use thereof. Such reservation by the Grantor shall in no event include the right to
locate or erect or cause to be located or erected any building or any other structure or mobile home trailer
unit upon the easement herein granted.
"Grantor" shall include the plural and the feminine. This easement shall be binding upon, and shall
inure to the benefit of the heirs, personal representatives, successors, or assigns of the Grantor and
Grantee.
