A RESOLUTION ACCEPTING AN EASEMENT FROM CHASE
MANHATTAN REALTY LEASING CORPORATION, A NEW YORK
CORPORATION AND LEASE PLAN NORTH AMERICA, INC., AN
ILLINOIS CORPORATION
WHEREAS, Chase Manhattan Realty Leasing Corporation, a New York Corporation and
Lease Plan North America, Inc., an Illinois Corporation, on April 9, 1997, granted an easement to
the City of Pueblo;
and
WHEREAS, such easement is necessary for a public sidewalk and Ingress Egress across
a portion of the property located at the SE Corner of Highway 50 and Morris Ave., and has been
approved as to form by the City Attorney;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO,
that:
Section 1
The easement granted by Chase Manhattan Realty Leasing Corporation, a New York
Corporation and Lease Plan North America, Inc., an Illinois Corporation, dated April 9, 1997, which
easement is on file with the City Clerk, is hereby approved and accepted.
Section 2
The City Clerk is directed to record said easement in the office of the Pueblo County Clerk
and Recorder.

Manhattan Realty Leasing Corporation, A New York Corporation and Lease Plan North America, Inc., an
Illinois Corporation , Grantor, to the CITY OF PUEBLO, a Municipal Corporation, Grantee:
WITNESSETH:
THAT FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) and other good and
valuable consideration, paid by Grantee, receipt of which is hereby acknowledged, Grantor hereby grants
to Grantee, its successors and assigns, an easement for the purpose of public sidewalk, in, through, over,
under and across Grantor's property situated in Pueblo County, Colorado, commonly known as Parcel "A"
Country Club Heights 14th Filing_ and described as follows:
An 11.50 Feet wide Sidewalk and Ingress Egress Easement located in Parcel "A"
in the Lot Line Rearrangement, Book 2946, Page 23 of Country Club Heights 14th
Filing in the Records of the Pueblo County Clerk and Recorder, County of Pueblo,
State of Colorado, being more particularly described as follows:
The POINT OF BEGINNING being a pin and cap LS #16128 on the south Right of Way
line of Highway 50 Frontage Road and the west Right of Way line of Morris Avenue,
thence S 11 °- 42' -09" W a distance of 222.46' along the west Right of Way of Morris
Avenue to a pin and cap LS #16128, thence N 78 °- 17' -40" W a distance of 11.5'
along the south lot line of Parcel "A ", thence N 11 °- 42' -09" E a distance of 222.46'
to point on the south Right of Way line of the frontage road, thence S 78 °- 18' -49" E
a distance of 11.50' along the south Right of Way of the frontage road to the POINT
OF BEGINNING.
Said parcel contains 0.06 acres.
TOGETHER WITH the right to enter upon said property for the purpose of construction,
maintenance, control, and repair, and together with the right to use so much of the adjoining property of
Grantor that may be reasonably necessary during the period of initial construction for said purposes. The
Grantor reserves the right to use and occupy said property for any purpose consistent with the right and
privilege above granted and which will not interfere with or endanger any of the Grantee's equipment or
facilities therein or use thereof. Such reservation by the Grantor shall in no event include the right to
locate or erect or cause to be located or erected any building or any other structure or mobile home trailer
unit upon the easement herein granted.

"Grantor" shall include the plural and the feminine. This easement shall be binding upon, and shall
inure to the benefit of the heirs, personal representatives, successors, or assigns of the Grantor and
Grantee.
