A RESOLUTION ACCEPTING A WARRANTY DEED FROM
VERNON E. PROCTOR AND JOAN W. PROCTOR FOR ROADWAY PURPOSES
WHEREAS, Vernon E. Proctor And Joan W. Proctor, on February 24, 1997, granted
a warranty deed to the City of Pueblo; and
WHEREAS, such Deed is necessary to construct curb and gutter and paving on
Red Creek springs Road, and has been approved as to form by the City Attorney; now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL, OF PUEBLO, COLORADO, that:

The Warranty Deed granted by Vernon E. Proctor And Joan W. Proctor, dated
February 24, 1997, which Deed is on file with the City Clerk, is hereby approved and accepted.
The City Clerk is directed to record said Warranty Deed and a certified copy of this
Resolution in the office of the Pueblo County Clerk and Recorder.

WITNESSETH, That the rantor for and inconsideration of the sum of

TOGETHER with all and singular the hereditaments and appurtenances thereto belonging, or in anywise appertaining, and the reversion and
reversions, remainder and remainders, rents, issues and profits thereof, and all the estate, right, title, interest, claim and demand whatsoever of the
grantor, either in law or equity, of, in and to the above bargained premises, with the hereditaments and appurtenances.

TO HAVE AND TO HOLD the said premises above bargained and described, with the appurtenances, unto the grantee, his heirs and assigns
forever. And the grantor, for himself, his heirs, and personal representatives, does covenant, grant, bargain, and agree to and with the grantee, his heirs and
assigns, that at the time of the ensealing and delivery of these presents, he is well seized of the premises above conveyed, has good, sure, perfect, absolute
and indefeasible estate of inheritance, in law, in fee simple, and has good right, full power and lawful authority to grant, bargain, sell and convey the same
in manner and form as aforesaid, and that the same are free and clear from all former and other grants, bargains, sales, liens, taxes, assessments,
encumbrances and restrictions of whatever kind or nature soever, except general taxes for 1997 and subsequent
years; except easements, restrictions, covenants, conditions, reservations and
rights of way of record, if any;
The grantor shall and will WARRANT AND FOREVER DEFEND the above - bargained premises in the quiet and peaceable possession of the grantee,
his heirs and assigns, against all and every person or persons lawfully claiming the whole or any part thereof. The singular number shall include the plural,
the plural the singular, and the use of any gender shall be applicable to all genders.

A parcel of land located in the City of Pueblo, County of Pueblo, State of Colorado, to-
wit:
A parcel of land being a part of the SW1 /4 of the SE1 /4 of Section 4, Township 21
South, Range 65 West of the 6th Principal Meridian, more particularly described as
follows;
BEGINNING at the northwest corner of The Meadows Filing No. 1 according to the plat
recorded November 23, 1977 in Book 1911 at Page 474 in the records of the Pueblo
County Clerk and Recorder;
Thence S01 0 22'39 "W, along the west line of said recorded subdivision, a distance of
50.00 feet;
Thence N88 0 37'21 "W a distance of 586.29 feet;
Thence N01 a distance of 50.00 feet to a point on the south line of that parcel
of land described in that document recorded in Book 39 at Page 398 in the records of
the Pueblo County Clerk and Recorder;
Thence S88 0 37'21 "E, along said south line, a distance of 586.29 feet to the POINT OF
BEGINNING.
