RESOLUTION NO. 8037 A RESOLUTION AUTHORIZING A RELEASE OF EASEMENTS TO JAMES E. O'NEAL, AS DEVELOPER AND OWNER OF GATEWAY SUBDIVISION, FIFTH FILING BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: Section 1. The attached release of easements between Pueblo, a Municipal Corporation, and James E. O'Neal, having been approved as to form by the City Attorney, is hereby approved. Section 2. The President of the City Council is hereby authorized and directed to execute such Release on behalf of the City of Pueblo. The City Clerk is directed to attest same and affix the seal of the city thereto. Section 3. RELEASE OF EASEMENTS This release of easements is made on January 27, 1997 by Pueblo, a Municipal Corporation (City) whose legal address is One City Hall Place, Pueblo, Colorado 81003, to James E. O'Neal (owner) of Boulder, Colorado. WHEREAS, the Owner is the developer and property owner for the property known as GATEWAY Subdivision, 5th Filing, according to the recorded plat thereof; and WHEREAS, the Owner is the Grantor and the City is the Grantee of two easements described in attached Exhibit "A" for temporary drainage easements across Owner's property; and WHEREAS, the Owner has agreed to grant to the City alternate easements for such purposes; and WHEREAS, the City and Owner desire to relocate such easements in and across Gateway Subdivision, Fifth Filing. NOW THEREFORE in consideration of Owner granting certain easements on the plat of Gateway Subdivision, Fifth Filing, the City hereby releases the easements described in attached Exhibit "A ". EXHIBIT "A" Description of easements to be released by Pueblo, A Municipal Corporation, for Gateway Subdivision Fifth Filing. EASEMENT No. 1: All that portion of the 20 foot temporary darinage easement, described in Book 2602 at Page 860 of the Pueblol County records, lying within the boundaries of Gateway Subdivision, Fifth Filing, according to recorded plat thereof. EASEMENT No. 2: All that portion of the 25 foot temporary drainage easement, described in Book 2386 at page 167 of the Pueblo County records, lying within the boundaries of Gateway Subdivision fifth Filing, according to the recorded plat thereof.
