A RESOLUTION FINDING SUBSTANTIAL COMPLIANCE
WITH COLORADO REVISED STATUTES SECTION 31 -12-
107 (1) OF THE PETITION FOR ANNEXATION OF THE
AREA COMMONLY KNOWN AND DESCRIBED AS 1201 E.
NORTHERN AVENUE
WHEREAS, a Petition For Annexation of the area described
in Section 1 hereof has been filed with the City Clerk, NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO,
that:
SECTION 1.
The Petition For Annexation of the following described
area situated in Pueblo County, Colorado, is hereby found and
determined to be in substantial compliance with the provisions
of C.R.S. X31 -12 -107 (1):
A parcel of land described in Special Warranty
Deed filed for record February 24, 1996 in
Book 2640 at Pages 806 -811 in the records of
the Pueblo County Clerk and Recorder, which
reads as follows:
A tract of land located in the SW 1/4 SE 1/4
of Section 6, Township 21 South, Range 64
West of the 6th Principal Meridian in Pueblo
County, Colorado, as follows:
Beginning at the northeast corner of the said
SW 1/4 SE 1/4, Section 6, thence S 00 0 05' W
along the easterly line of the said SW 1/4
SE 1/4, Section 6, a distance of 59.58 feet
to a point on the north line of the vacated
Northern Avenue; thence along said vacated
Northern Avenue for the following seven courses:
S 78 °11'30 "W, a distance of 53.98 feet to a point;
thence S 82 °16'30" W, a distance of 57.87 feet to a
point;
thence S 80 a distance of 58.58 feet to a
point; thence S 80 a distance of 29.80 feet
to a point; thence S 78 0 57 1 30" W, a distance of
85.48 feet to a point; thence S 69 °56' W, a
distance of 88.77 feet to a point; thence
S 65 0 20' W, a distance of 96.71 feet to a point
which is the southeasterly corner of Parcel
26 Rev. of Department of Highways Project
SU 0168 (1); thence N O1 a distance
of 195.17 feet along the east line of Parcel
26 Rev. of Department of Highways Project
SU 0168 (1) to a point on the north line of
the said SW 1/4 SE 1/4, Section 6 which point
is located S 88 a distance of 862.91
feet from the northwest corner of the said
SW 1/4 SE 1/4, Section 6; thence S 88
along the north line of the said SW 1/4 SE 1/4,
Section 6, a distance of 447.09 feet to the
point of beginning, containing 1.168 acres, more
or less,
SECTION 2.
A public hearing to determine if the area proposed to be
annexed meets the applicable requirements of C.R.S. §31 -12 -104
and §31 -12 -105 to establish eligibility for annexation under
the Municipal Annexation Act of 1965 shall be held before the
City Council in Council Chambers, Second Floor, City Hall, One
City Hall Place, Pueblo, Colorado, on Monday, December 23, 1996
commencing at 7:30 o'clock p.m. or as soon thereafter as
City Council Business allows. The City Clerk shall publish
notice of the public hearing once a week for four successive
weeks in the Pueblo Chieftain. The first publication of such
notice shall be at least thirty (30) days prior to the date of
the hearing. A copy of the published notice, together with a
copy of the Petition For Annexation shall be sent by registered
mail by the City Clerk to the Board of County Commissioners and
the County Attorney of Pueblo County and to any school district
or special district having territory within the area to be
annexed at least twenty -five days prior to the date of the
hearing.
