A RESOLUTION FINDING SUBSTANTIAL COMPLIANCE
WITH COLORADO REVISED STATUTES SECTION 31 -12-
107 (1) OF THE PETITION FOR ANNEXATION OF THE
AREA COMMONLY KNOWN AND DESCRIBED AS SOUTHEAST
CORNER PUEBLO BOULEVARD AND U.S. HIGHWAY 50
WEST
WHEREAS, a Petition For Annexation of the area described
in Section 1 hereof has been filed with the City Clerk, NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO,
that:
SECTION 1.
The Petition For Annexation of the following described
area situated in Pueblo County, Colorado, is hereby found and
determined to be in substantial compliance with the provisions
of C.R.S. X31 -12 -107 (1):
All of Parcels A, B an C in Subdivision Variance
No. 339, acording to the recorded plat thereof,
filed for record October 29, 1982 in Book 2132 at
Page 755 of the Pueblo County records
AND
All of Lots 5 through 13, both inclusive, Block
4 and all of Lots 4 through 13, both inclusive,
Block 5 in Holiday Hills No. 3, according to the
recorded plat thereof, filed for record July 21,
1961
AND
A tract located in the West half of the Northwest
Quarter of Section 15, Township 20 South, Range
65 West, 6th P.M., said tract being more particu-
larly described as follows: Beginning at a point
of intersection of the South line of the Northwest
Quarter of said Section 15 and the Easterly Right -
of -Way line of Pueblo Boulevard, from which point
the west Quarter corner of said Section 15 bears
South 88 °43'53" West a distance of 80.0 feet;
thence North 29 °07'23" East along the Easterly
right -of -way line of Pueblo Boulevard, a distance
of 478.0 feet; thence North 17 °20'53" East contin-
uing along the easterly right -of -way line of Pueblo
Boulevard, a distance of 293.70 feet; thence North
18 °05'53" East continuing along the easterly right -
of -way line of Pueblo Boulevard, a distance of
416.97 feet; thence North 88 °43'53" East and
parallel with the South line of the Northwest
Quarter of said Section 15, a distance of 739.47
feet; thence South 1 °37'56" East a distance of
1084.05 feet to a point on the South line of the
Northwest quarter of said Section 15; thence
South 88 °43'53" West along the South line of
the Northwest Quarter of said Section 15 a
distance of 1220.21 feet more or less, to the
point of beginning, County of Pueblo, State of
Colorado, less that portion thereof conveyed to
Davis Recreation Center, Inc. by warranty deed
recorded April 5, 1977 in Book 1882, Page 15
of the Pueblo County Clerk and Recorder records,
containing 55 acres, more or less.
SECTION 2.
A public hearing to determine if the area proposed to be
annexed meets the applicable requirements of C.R.S. 531 -12 -104
and X31 -12 -105 to establish eligibility for annexation under
the Municipal Annexation Act of 1965 shall be held before the
City Council in Council Chambers, Second Floor, City Hall, One
City Hall Place, Pueblo, Colorado, on Monday, August 26, 1996
commencing at 7:30 o'clock p.m. or as soon thereafter as
City Council Business allows. The City Clerk shall publish
notice of the public hearing once a week for four successive
weeks in the Pueblo Chieftain. The first publication of such
notice shall be at least thirty (30) days prior to the date of
the hearing. A copy of the published notice, together with a
copy of the Petition For Annexation shall be sent by registered
mail by the City Clerk to the Board of County Commissioners and
the County Attorney of Pueblo County and to any school district
or special district having territory within the area to be
annexed at least twenty -five days prior to the date of the
hearing.
